Analysis

This resolution authorizes and directs the proper City officers to execute a Water, Sewer and Maintenance Easement SE-2764, WE-921 with Palermos Properties, LLC in property owned by Palermos adjacent to the 35^th Street Viaduct between West Canal Street and the Menomonee River in the Menomonee Valley.

Body

Whereas, The area known as the Menomonee Valley is currently being redeveloped by the City of Milwaukee (City); and

Whereas, A parcel in the Menomonee Valley redevelopment has been purchased by Palermos Properties, LLC (Palermos) from the Redevelopment Authority of the City of Milwaukee for constructing a new facility; and

Whereas, The City is regrading the area and constructing new roads and utilities to make the area amenable to light industrial manufacturing facilities; and

Whereas, The City has constructed a sanitary sewer in the property purchased by Palermos; and

Whereas, The City requires access to the same land where the sanitary sewer was constructed for inspection and maintenance activities on the 35^th Street Viaduct; and

Whereas, The City may find it necessary to construct water mains in the same area where the sanitary sewer was constructed; and

Whereas, An easement document has been prepared by the City defining the area and conditions of use; and

Whereas, The document has been executed by Palermos Properties, LLC and the Redevelopment Authority of the City of Milwaukee; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City officers are hereby authorized and directed to execute Water, Sewer and Maintenance Agreement SE-2764/WE-921, a copy of said easement being attached to Common Council File Number 050968 and incorporated in this resolution by reference as though set forth in full; and, be it

Further Resolved, That after said easement has been executed by the proper City officers, it shall be forwarded to the Office of the City Attorney for approval as to form and execution and then to the Department of Public Works for recording and proper distribution.
