Title
Resolution authorizing the jurisdictional transfer of the City-owned property at 1901 South Kinnickinnic Avenue from the Milwaukee Water Works to the Department of Public Works for use by the City Election Commission, in the 12th Aldermanic District.
Analysis
This resolution authorizes the jurisdictional transfer of a City-owned property from the Milwaukee Water Works to the Department of Public Works for the benefit of the Election Commission.
Body
Whereas, The City Election Commission has been leasing approximately 17,400 square feet of storage and office space in a privately owned building at 4200 North Holton Street since 2008 when it was relocated from the Hawley Road Municipal Warehouse as a result of the property sale to the Milwaukee Metropolitan Sewerage District for flood mitigation; and
Whereas, The City's lease at 4200 North Holton Street has expired and the Election Commission has investigated alternate space in public and private facilities; and
Whereas, The Election Commission was notified that the Milwaukee Water Works' meter testing and repair facility at 1901 South Kinnickinnic Avenue will become mostly vacant at the end of 2014 as a result of space consolidation by the Milwaukee Water Works at its facility at 2919 West Cameron Avenue; and
Whereas, The building at 1901 South Kinnickinnic Avenue is suitable for use by the Election Commission because of its configuration and 24,000 square feet of warehouse and office space and a secure, enclosed loading dock and its proximity to vehicular routes and public transportation; and
Whereas, Continued use by a municipal entity will allow the Milwaukee Water Works to retain a large meter testing facility in the building without interfering with Election Commission activities and will allow a City communications facility and underground conduit to remain without modification that will save relocation and building modification expenditures; and
Whereas, The Milwaukee Water Works and the Election Commission have agreed that compensation of $500,000 will be paid to the Milwaukee Water Works over a ten-year period by the Election Commission commencing with its occupancy in April 2015; and
Whereas, The City Real Estate Officer reviewed the proposed compensation and determined that the amount is reasonable based on a review of comparable industrial sales, analysis of the building's functional utility and condition and consideration of remaining public installations; and
Whereas, A Memorandum of Understanding ("MOU") among the Election Commission, the Milwaukee Water Works and the Department of Public Works has been drafted to outline the terms of payment and continued use of the property; and
Whereas, The Department of Public Works will maintain the building on behalf of the Election Commission; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the jurisdiction for the property at 1901 South Kinnickinnic Avenue is transferred from the Milwaukee Water Works to the Department of Public Works for use primarily by the Election Commission; and, be it
Further Resolved, That the Election Commission, the Milwaukee Water Works and the Department of Public Works are directed to enter into said MOU, which outlines the terms of payment and continued use of the property; and, be it
Further Resolved, That the Election Commission shall compensate the Milwaukee Water Works $500,000 over a 10-year period as outlined in the MOU.
