This ordinance codifies resolution provisions relating to the composition and duties of the deferred compensation plan board. In addition, this ordinance requires certain city employes appointed to the board, and the designees of certain board members, to be members of the city's deferred compensation plan at the time of appointment.

BODY:

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1. Section 320-17 of the code is created to read:

 

320-17. Deferred Compensation Plan Board.

 

1. CREATION. a. There is created a deferred compensation plan board consisting of 9 members:

 

a-1. The mayor.

 

a-2. The chair of the common council's finance and personnel committee.

 

a-3. The city attorney.

 

a-4. The city comptroller.

 

a-5. The city treasurer.

 

a-6. The director of employe relations.

 

a-7. One management plan employe appointed by the mayor for a term of 3 years.

 

a-8. One nonmanagement plan employe appointed by the mayor for a term of 3 years.

 

a-9. One nonmanagement plan employe appointed by the common council president for a term of 3 years.

 

b. Members listed under par. a-1 to 6 may designate designees, and must do so in writing to the city clerk's office. Such designees may represent their respective principal members and exercise all powers of those members when such members are unable to attend board meetings.

 

c. The following members must be members of the city's deferred compensation plan at the time of appointment:

 

c-1. Members appointed pursuant to par. a-7 to 9, commencing in 1998 when terms expire for such members.

 

c-2. Designees of members listed under                     par. a-1 to 6, commencing on the effective date of this ordinance [city clerk to insert date].

 

d. Members appointed pursuant to par. a-7 to 9 shall be confirmed by the common council.

 

e. Commencing in 1998 when terms expire for members appointed pursuant to par. a-7 to 9, such members shall be appointed for terms expiring the 3rd Tuesday of April 2000; thereafter such members shall be appointed for a term of 2 years within 60 days of the commencement of a new common council - mayoral term and then within 60 days following 2 years of the commencement of a term; and, if a vacancy occurs in any of these positions, an appointment shall be made within 60 days after a vacancy occurs.

 

2. DUTIES. The board shall promulgate such rules as may be necessary to supervise and direct the city's deferred compensation plan, pursuant to s. 5-50, city charter. A copy of such rules shall be filed in the city clerk's office and the legislative reference bureau.

 

3. STAFFING. The deferred compensation plan unit shall provide assistance to the board.

 

 

 

Part 2. Resolution File Numbers 951006 and 960228 are rescinded.

 

Part 3. This ordinance takes effect upon the effective date of charter ordinance file number 971476.
