This resolution amends Common Council File Number 212035 authorizing the Office of the City Attorney to retain outside legal counsel to provide legal services to the City of Milwaukee for the Equal Rights Division complaint and any related state or federal court litigation subsequently filed by former Assistant City Attorney Naomi Gehling to increase the maximum dollar amount from $20,000 to $50,000.

Whereas, On May 10, 2022, the Common Council adopted Resolution File Number 212035, authorizing the Office of the City Attorney to retain outside legal counsel to provide legal services to the City of Milwaukee for the Equal Rights Division complaint and any related state or federal court litigation subsequently filed by former Assistant City Attorney Naomi Gehling; and

Whereas, The resolution specified that the dollar amount appropriated from the City Attorney’s Office Outside Counsel Expert Witness Special Purpose Account Number 0001-1490-S157-06300 for retaining outside counsel shall not exceed $20,000 and that the City Attorney is directed to expend up to that amount from this account for this purpose; and

Whereas, The cost associated with this litigation is anticipated to exceed $20,000; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that Resolution File Number 212035 is amended by deleting the last two “Further Resolved” clauses and inserting in lieu thereof the following:

“Further Resolved, That an amount not to exceed $50,000 is appropriated from the City Attorney’s Office Counsel Expert Witness Special Purpose Account Number 0001-1490-S157-06300 for retaining outside counsel; and, be it

“Further Resolved, That the Office of the City Attorney is directed to expend up to $50,000 from this account for this purpose.”
