Analysis

This resolution authorizes an initial appropriation of $5,000 from the Common Council Contingent Fund to the OutsideCounsel/Expert Witness Special Purpose Account for the purpose of providing outside counsel to the Employes' Retirement System/Annuity and Pension Board in Elias v. Milwaukee Employes' Retirement System/Annuity and Pension Board and the City of Milwaukee, Case No. 97-CV-000973.

BODY:

Whereas, The Employes' Retirement System/Annuity and Pension Board have negotiated a contract with Whyte Hirschboeck Dudek, S.C., to represent them in Elias v. Milwaukee Employes' Retirement System/Annuity and Pension Board and the City of Milwaukee, Case No. 97-CV-000973 (Duty Disability Conversion Case); now, therefore, be it

Resolved, That the sum of $5,000 be appropriated from the Common Council Contingent Fund (09-910-8000) to the Outside Counsel/Expert Witness Fund Special Purpose Account (01-023-8001) and the City Attorney's Office Account (01-023-8002) for the purpose of retaining outside counsel Whyte Hirschboeck Dudek, S.C., to represent the Employes' Retirement System/Annuity and Pension Board in Elias v. Employes' Retirement System/Annuity and Pension Board and the City of Milwaukee, Case No. 97-CV-000973; and, be it

Further Resolved, That the attached agreement with Whyte Hirschboeck Dudek, S.C., be approved for an amount not to exceed $5,000 at a rate not to exceed $150 per hour, such amounts to be expended upon the presentation and approval of invoices for service by the Office of the City Attorney.
