Title
Substitute resolution authorizing creation of and membership in the Wisconsin Municipalities Private School Finance Commission by the City of Milwaukee, Wisconsin.
Analysis
This substitute resolution authorizes the City to join with another Wisconsin municipality in creating an Intergovernmental Cooperation Commission for the financing of private primary and secondary schools; and approves and authorizes the execution and delivery of a Charter-Contract to establish the commission.
Body
Whereas, Section 66.0301 of the Wisconsin Statutes authorizes a municipality to contract with one or more other municipalities for the joint exercise of any power or duty authorized or required by law and for the creation of a commission that can finance regional projects under Section 66.0621 of the Wisconsin Statutes; and
Whereas, The City of Milwaukee, Wisconsin (hereinafter the "City") desires to create, together with another municipality in the State of Wisconsin, an Intergovernmental Cooperation Commission (hereinafter, the "Commission"), the function of which will be to assist in the financing of private regional educational and related facilities; and
Whereas, The Commission will be authorized from time to time to issue revenue obligations pursuant to the provisions of Sections 66.0301 and 66.0621 of the Wisconsin Statutes (the "Bonds") in its name, on behalf of and at the behest of the member municipalities to finance any such facilities owned by the Commission and operated for a public purpose; and
Whereas, The City and the Commission will assist in the financing of such educational facilities without discrimination based upon the religious affiliation (or lack thereof) of the operator of the facilities or upon the religious content (or lack thereof) of the curriculum or other programs; and
Whereas, The Common Council has reviewed the proposed form of Intergovernmental Charter-Contract (hereinafter, the "Charter") which would form the Commission; and
Whereas, The Common Council has found and determined that it is in the best interests of the City to participate in the creation of, become a member of, the Commission; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that:
1. The City agrees to create, together with any other municipality of the State of Wisconsin, and to become a member of the Commission. To that end, all of the provisions of the Charter are adopted and approved.
2. The proper City officials are authorized and directed to execute and deliver the Charter in the manner provided therein.
3. Prior resolutions or portions thereof, which conflict with this resolution, are repealed.
4. The approval for financing, by the Commission, of any Qualified Educational Facility located in the City shall be subject to the guidelines set forth in Exhibit A, a copy of which is attached to this Common Council File.
5. Minor, non-substantive changes may be made to the Charter with the concurrence of the City Attorney, City Comptroller, and Commissioner of City Development.
