This resolution directs the installation and construction of certain public improvements which have been determined to be nonassessable by the Commissioner of Public Works.
BODY:
Whereas, The Common Council of the City of Milwaukee adopted preliminary resolutions determining it necessary and in the public interest to construct nonassessable improvements; and
Whereas, Plans, specifications and cost estimates have been prepared for the following described improvements:
1st Aldermanic District
N. 31st St. - Alley north of W. Capitol Dr. to W. Hope St. (858-0014-0) File Number 961875: Relay storm sewer. (Nonassessable Relief and Relay Sewer Fund 31-523---171-0001 -- $113,000)

Resolved, By the Common Council of the City of Milwaukee that the Commissioner of Public Works is authorized and directed to proceed with said work; and, be it
Further Resolved, That the City Comptroller is authorized and directed to transfer such funds which are available for this purpose to the appropriate capital purpose subaccounts; and, be it
Further Resolved, That the City Engineer and the Commissioner of Public Works are hereby authorized to negotiate and enter into an agreement with the State of Wisconsin, Department of Transportation for the City to undertake construction management duties on the following project: W. Cherry St. Structure
;and, be it
Further Resolved, That the City Engineer is authorized and directed to approve and make periodic payments to the State of Wisconsin, Department of Transportation after receipt of invoices from said State for the City's share of the costs for said project:
W. Cherry St. Structure (894-0051-9) Nonassessable Fund 32-523---550-0001 -- $19,835 Nonassessable Structure Funds -- $153,000
;and, be it
Further Resolved, That upon the completion of project 894-0051-9 and a determination of the actual cost, it is understood that if the City of Milwaukee's share is less than the amount previously paid, the difference will be refunded to said City.
