Substitute resolution authorizing and directing the proper City officers to execute an Out-of-Program Agreement between Gorman and Company, Inc. and the City of Milwaukee for construction of public improvements to support the Arbor Ridge apartment development to be located at the southeast corner of West Bradley Road and North 107th Street.

- ANALYSIS - This resolution approves an Out-of-Program Agreement between a private developer and the City whereby the developer will provide up-front funding for public improvements needed for the planned Arbor Ridge apartment complex and the City will provide a partial refund in the year following completion.

 

 

BODY:

Whereas, Gorman and Company, Inc. has plans to construct a multi-building apartment complex at the southeast corner of North 107th Street and West Bradley Road; and

 

Whereas, This development will require various public improvements including the extension of a main water line through the site and a new median opening on North 107th Street; and

 

(WE 828) 1280 ft. m/l north of W. Calumet Rd. at 600 ft. m/l east of N. 107th St. to 600 ft. m/l south of W. Bradley Rd. at N. 107th St. (828-1585-5) File Number 970751: Water main extension for reinforcement. (Developer Water Fund 42-641---301-0001 -- $195,000)

 

N. 107th St. - 520 ft. m/l south of W. Bradley Rd.: Median revision. (Developer Paving Fund 72-523---210-8000 -- $50,000)

 

Whereas, The Common Council has previously approved acceptance of developer funds for preliminary engineering; and

 

Whereas, Gorman and Company, Inc. now desires to enter into an Out-of-Program Agreement with the City of Milwaukee to provide for construction of the required public improvements; and

 

                      Whereas, City policy normally requires residential developers to fund the entire cost of related public improvements when the benefits of such improvements are limited to the project in question; and

 

Whereas, The median work on North 107th Street will include closing an existing median opening with the resulting new median opening being better located and designed to accommodate expected increases in North 107th Street traffic generated by other developments in the area; and

 

Whereas, It would thus be appropriate for the City to fund the median improvements; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee that a substitute Out-of-Program Agreement providing for a developer refund for median improvement costs is hereby approved and the proper City officials are hereby authorized and directed to execute said agreement on behalf of the City; and, be it

 

Further Resolved, That the Commissioner of Public Works is authorized to make minor, nonsubstantive changes to the Out-of-Program Agreement prior to its execution; and, be it

 

Further Resolved, By the Common Council of the City of Milwaukee that a variance is authorized from the procedures of File Number 881665, being the Administrative Rules for the Capital Improvements Process, and hereby directs the City Comptroller to make a supplemental appropriation of $195,000 in the Developer Out-of-Program Capital Purpose Account (42-641---301-0001) with offsetting revenues in Water Estimated Revenue (42-641---301-9003); and, be it

 

Further Resolved, That the City Comptroller is hereby authorized to make the necessary funding and accounting entries, including increasing the Milwaukee Water Works' Developer Out-of-Program Capital Purpose Account and offsetting revenues to appropriately reflect the intent of this action and assure adequate cost recovery.

 

Further Resolved, That after the developers of said development deposit the necessary funds in accordance with said agreement, the Commissioner of Public Works is authorized and directed to proceed with said work.
