Analysis

Resolution authorizing the proper City officials to execute a sewer easement for the City of Milwaukee sanitary sewer in East Howard Avenue between the Milwaukee City Limits and a point approximately 210-feet east of South Kansas Avenue in East Howard Avenue in St. Francis’ municipal boundaries and the Milwaukee City Limits.

Body

Whereas, Milwaukee is requesting a sewer easement from St. Francis for the sanitary sewer manhole serving as the connection point between the Milwaukee and St. Francis sanitary sewers at a point approximately 210-feet east of South Kansas Avenue in East Howard Avenue in St. Francis’ municipal boundaries and for the 8-inch sanitary sewer line between said manhole and the Milwaukee City Limits; and

Whereas, St. Francis owns and operates an existing 8-inch sanitary sewer in East Howard Avenue which is connected directly to the existing sanitary sewer owned and operated by Milwaukee; and

Whereas, Milwaukee would own and operate the aforementioned sanitary sewer manhole and the sanitary sewers west of the new manhole and St. Francis would own and operate the sanitary sewers east of the manhole; and

Whereas, St. Francis is willing to grant such easement on the terms and conditions set forth in the easement document that has been made part of this file; and

Resolved, by the Common Council of the City of Milwaukee, that the proper City officials, including pthe Commissioner of Public Works, are hereby authorized: (i) to sign Sewer Easement in the form and substance submitted to this file (or in substantially the same form and substance as submitted, and to effectuate the intent of this resolution); and (ii) to cause the same to be recorded in the Milwaukee County Register of Deeds Office.
