Substitute resolution accepting the unsolicited Offer to Purchase the surplus, improved, tax deed property located at 3121 West Michigan Street, in the 4th Aldermanic District.

This substitute resolution accepts the unsolicited Offer to Purchase received for said property.

BODY:

Whereas, Said property was declared surplus and advertised for sale via the open listing method in accordance with Common Council File No. 970918, adopted October 14, 1997, and the prospective buyer has been unable to close the transaction on several occasions; and

 

Whereas, Recently an Offer to Purchase said property was submitted by Thomas and Melina Austin at a price below the minimum acceptable price as indicated below:

 

3121 West Michigan Avenue, TK #401-2052-X

Common Council Approved Minimum Asking Price - $3,825

Unsolicited Offer Price - $3,000*

*Broker's commission of $1,250 to be deducted from the Unsolicited Offer Price.

 

; and

 

Whereas, Thomas and Melina Austin desire to purchase said property for rehabilitation and use as their primary residence; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee that the Commissioner of the Department of City Development is authorized and directed to accept the unsolicited Offer to Purchase said property from Thomas and Melina Austin at the offer price of $3,000; and, be it

 

Further Resolved, That the proper City officials are authorized and directed to perform such acts as may be required to consummate the sale of said property and that the proceeds be credited to the Reserve For Tax Deficit Fund Account No. 02-211-2700; and, be it

 

Further Resolved, That as a condition of the sale of surplus property, purchaser is required to bring property into compliance with applicable building codes within the time specified by the Building Inspection Department or said property may revert back to the ownership of the City of Milwaukee upon action by the Common Council.
