Resolution relative to the application, acceptance, and funding of revised Funding Agreement for an Inflow and Infiltration grant from the Milwaukee Metropolitan Sewerage District, increasing the grantor funding by $1,455,000 to $3,631,000, for the project in the Clemens School Area west of North 35th Street and north of West Capitol Drive.
 
Analysis
This resolution authorizes the Department of Public Works, Infrastructure Services Division to accept and fund additional work for the Inflow and Infiltration (I/I), Demonstration project in the amount of $1,455,000 with an Milwaukee Metropolitan Sewerage District (MMSD) reimbursement amount of $1,455,000 with the City of Milwaukee (City) paying for additional costs above the allocated amount. The purpose of the funding is to reduce the amount of I/I, ultimately reducing the chances of basement backups to residents in the project area in the Clemens School Area west of North 35th Street and north of West Capitol Drive.
 
This area was identified by the City Of Milwaukee and MMSD as having high levels of inflow and infiltration.  This resolution also authorizes the Commissioner of Public Works to execute a funding agreement between the City and the MMSD.
Body
 
Whereas, The City is eligible for additional funding in 2013 from the Milwaukee Metropolitan Sewerage District (MMSD) through its private property Inflow and Infiltration (I/I) reduction program; and
 
Whereas, The work proposed for this area is for the rehabilitation of approximately 450 additional sanitary building sewers (laterals) utilizing a cured-in-place lining (trenchless) method; and
Whereas, The additional work includes 182 laterals that showed high amounts of I/I. These laterals will be rehabilitated utilizing cured-in-place lining (trenchless) method under the existing contract; and  
 
Whereas, This program is 100% voluntary and property owners can opt out at any time; and
 
Whereas, The MMSD has offered to reimburse the City with additional funds not to exceed $1,455,000 totaling $3,631,000 for the project; and
 
Whereas, The operation of the additional funding for the I/I project is effective from the date the agreement is executed through December 2013 and is estimated to cost $1,455,000 of which $1,455,000 would be reimbursed by the MMSD upon completion; and
 
Whereas, Department of Public Works/Infrastructure Services has committed funds for the partial cost of the project per common council file Number 121204 (SM494120218); now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby authorized to accept such a fund without further Common Council approval unless the terms of the grant change as indicated in Common Council file 030712 (Grant Ordinance); and, be it
 
Further Resolved, That upon approval of this contract, the City Comptroller is hereby authorized to create within the Capital Grant and Aid Projects Fund the appropriate Project/Grant Chartfield Value for this project; and transfer to these accounts the amount required under the agreement and City accounting policy, but not to exceed a ten percent increase of the total amounts reserved for the grantor's share and local share or $5,000, whichever is greater as follows:

Further Resolved, That these funds are appropriated to the Department of Public Works, Infrastructure Services Division which is authorized to expend from the amount budgeted for specific purposes as indicated in the grant budgets and incur costs consistent with the award date; and, be it
Further Resolved, That these funds are budgeted for the Department of Public Works which is authorized to expend from the amount budgeted for specific purposes as indicated in the funding agreement and incur costs consistent with the project; and, be it
 
Further Resolved, That the Commissioner of Public Works is authorized and directed to execute a grant funding agreement between the City of Milwaukee and the MMSD regarding the Inflow and Infiltration Program grant; and, be it
 
Further Resolved, That the Commissioner of Public Works of the Department of Public Works shall have the authority to authorize transfers within the project budget so long as the amount expended for any purpose shall not exceed the amount authorized by the budget by 10% and such transfers are in accordance with grantor regulations; and, be it
Further Resolved, That the Commissioner of Public Works on behalf of the City of Milwaukee be authorized to enter into subcontracts (and leases) as detailed in the project budget and in accordance with City purchasing procedures and grant and aid guidelines for awarding such contracts.
