Analysis
This resolution authorizes and directs the Commissioner of Public Works to execute a document titled "Federal/State/Sponsor Transportation Enhancement/STP-D Program Project Agreement" with the Wisconsin Department of Transportation and the Federal Government for design, right-of-way acquisition and construction of a project known as the "Beer Line Bike/Recreational Corridor."
Body
Whereas, The Soo Line Railroad corridor between Milwaukee's downtown and Holton Street (known as the Beer Line) was abandoned in 1995 and acquired by CMC Heartland Partners; and
 
Whereas, The corridor between Pleasant Street and North Avenue is currently being developed as a bike trail by the City of Milwaukee Department of Public Works through a previous CMAQ grant; and
 
Whereas, Milwaukee County Department of Parks, Recreation and Culture has proposed to develop the corridor between North Avenue and Locust Street as a bike trail; and
 
Whereas, The City of Milwaukee Department of Public Works has made application for funding under the Local Transportation Enhancement Program to acquire the corridor between Chambers Street and Holton Street for a bike trail and recreational uses known as The Beer Line Bike/Recreational Corridor Project; and
 
Whereas, The Wisconsin Department of Transportation has approved this application and submitted a Project Agreement to be executed by the City of Milwaukee for design, right-of-way acquisition and construction of the Beer Line Bike/Recreational Corridor with Federal aid under the Transportation Enhancement Program; and
 
Whereas, Project costs are estimated at $716,000 and actual project costs will be funded by the grant at 80% up to a maximum of $572,800 with the remaining 20% funded by the City up to a maximum of $143,200; and
 
Whereas, Common Council File No. 020800 approved an Offer to Purchase a majority of the corridor from CMC contingent on the City of Milwaukee receiving and accepting the grant and subject to other conditions; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that the Commissioner of Public Works is hereby authorized and directed to execute the Project Agreement for design, right-of-way acquisition and construction of The Beer Line Bike/Recreational Corridor project, a copy of which is attached to Common Council File No.020239 and is incorporated as though set forth in full; and, be it
 
Further Resolved, That the Commissioner of Public Works is hereby authorized and directed to undertake or to engage a consultant to undertake preliminary engineering and/or perform real estate services acquisition services for The Beer Line Bike/Recreational Corridor project and to reimburse the Wisconsin Department of Transportation for design costs it incurs for the project; and, be it
 
Further Resolved, That future resolutions will seek authority to acquire the right-of-way and perform construction; and, be it
 
Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvement Fund, Grant and Aid Projects, the necessary Project/Grant Chartfield values for preliminary engineering/real estate acquisition services for the project (Expenditure) and transfer to these accounts the amount required under the grant agreement and City Accounting policy, but not to exceed 10% increase of the total amounts reserved for the grantor's share and local share of $5,000, whichever is greater, as follows:
