Title
Resolution directing the proper City officers to execute a sewer agreement allowing Midwest Products and Engineering Incorporated to construct within the limits of sewer easement SE-2080.
Analysis
This resolution directs the proper City officers to execute a sewer agreement SA-2080-A located at Midwest Products and Engineering property. The purpose of the agreement is to identify Midwest Products responsibility for the proper maintenance of proposed alterations and the City’s right to perform any maintenance activities over the easement area.
Body
Whereas, On April 9, 1974, the City was granted sewer easement SE-2080 for sewer and drainage purposes in the property located at 10597 West Glenbrook Court; and
Whereas, Sewer Easement SE-2080 is located on a parcel of land presently owned by Midwest Products; and
Whereas, Midwest Products requested from the City permission to construct a detention pond and an 8-inch diameter storm sewer pipe (ALTERATIONS) over SE-2080, with the purpose of facilitating the discharge of storm water runoff from a proposed building addition into the City’s storm sewer system; and
Whereas, Midwest Products has submitted a Storm Water Management Plan (SWMP) for said building addition and said plan has been approved by the City Engineer on December 1, 2006; and
Whereas, Said ALTERATIONS will provide storm water runoff drainage from the said building addition as approved in said SWMP; and
Whereas, The City will allow the construction of said ALTERATIONS in and over a portion of the easement area subject to the conditions stated in Sewer Agreement SA-2080-A, a copy of said agreement being attached to this Common Council File Number 061364 and incorporated in this resolution by reference as though set forth in full; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the proper City officers are hereby directed to execute Sewer Agreement SA-2080-A; and, be it
Further Resolved, That after said agreement document has been executed by the proper City officers, it shall be forwarded to the Office of the City Attorney for approval as to form and execution and then to the Department of Public Works for recording and proper distribution.
