Title
Resolution relating to Common Council approval of any reallocation of American Rescue Plan Act funds that may not be expended by December 31, 2026.
Analysis
This resolution stipulates that Common Council approval is required for any reallocation of ARPA funds that may not be expended by the end of 2026. It also prohibits the Comptroller from signing any contracts using ARPA funds without prior Common Council authorization.
Body
Whereas, Common Council File 210894 authorized programmatic expenditures of ARPA funds; and
Whereas, Common Council File 231182, passed on December 12, 2023, required that unused and unencumbered ARPA funds be under Common Council control; and
Whereas, In a memo to the Finance and Personnel Committee dated September 18, 2024 and attached to Common Council File Number 240360, the City’s ARPA Director identified $902,704 of ARPA funding that was expected to available for reprogramming before the end of 2024; and
Whereas, ARPA funding must be under contract by December 31, 2024 and fully spent by December 31, 2026; and
Whereas, The City may be at risk of losing ARPA funding if contractors or ARPA subgrant recipients encounter circumstances which prevent them from expending their ARPA allocations by December 31, 2026; and
Whereas, ARPA funds which remain unspent on December 31, 2026 will revert back to the United States Treasury; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that after December 31, 2024, Common Council approval is required for any reallocation of American Rescue Plan Act funds that may not be expended by the end of 2026, including funds reallocated to a new contractor within the original programmed allocation; and, be it
Further Resolved, That the Comptroller shall not sign any contract using reallocated ARPA funds without prior authorization from the Common Council.
