Title

A substitute ordinance relating to appeals of the decisions of the transit stop technical committee.

Analysis

This ordinance adds an appeal process that applies to the decisions of the transit stop technical committee.  Appeals shall be by a written request filed with the city clerk within 20 days after the decision is made by the committee.  After a public hearing, the council may, by vote of 2/3 of its members, affirm, reverse or modify the decision of the committee.

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1.  Section 320-28 of the code is repealed and recreated to read:

 

320-28.                     Transit Stop Technical Committee. 

1.  MEMBERSHIP.  There is created a transit stop technical committee consisting of 3 members:  the city engineer or his or her designee, a representative from Milwaukee Transport Services, Inc., and a citizen member appointed by the chair of the public works committee.  The citizen member shall be appointed no later than 60 days after the third Tuesday in April in even-numbered years to a 2-year term expiring on the third Tuesday of April 2 years thereafter. When a vacancy occurs in the citizen member position the appointing authority shall make an appointment within 60 days after the vacancy occurs.

2. PURPOSE.  a.  The committee shall approve all locations for the receiving and discharging of passengers of common carriers.

b.  If there is an objection to a decision made by the committee, an appeal may be made to the common council.  Appeals shall be by a written request filed with the city clerk within 20 days after the decision is made by the committee. The city clerk shall file the request to appeal with the common council. After a public hearing, the council may, by vote of 2/3 of its members, affirm, reverse or modify the decision of the committee, after balancing the interest of the public and the committee’s decision regarding the location for the receiving and discharging of passengers of common carriers.
