This ordinance makes minor revisions to the procedures for submitting applications for planned developments, for making minor modifications to general and detailed plans for planned developments, and for allowing the commencement of site work in planned developments.

BODY:

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1. Section 295-813-1 of the code is amended to read:

 

295-813. Applications. 1. FILING. An application for a planned development shall be submitted with required fees and [[14 copies of the plans]] >>documents<< to the city plan commission in accordance with s. 295-61-1. >>Such documents shall include 14 copies of the written "Project Description and Owner's Statement of Intent," 2 full-sized sets of graphic plans as required, and 10 sets of the graphic plans reduced to an 11-inch by 17-inch size. All subsequent amendments to the written and graphic materials shall be dated or otherwise identified.<<

 

Part 2. Section 295-813-4-0 of the code is repealed and recreated to read:

 

4.                     MINOR MODIFICATIONS. General and detailed plans may be modified, subject to approval by common council resolution, provided that such minor modifications will not cause:

 

Part 3. Section 295-814-4 of the code is repealed. (Note: The provisions being repealed read as follows:

 

295-814. Review and Approval.

 

4.                     RECORDING. Whenever the common council amends the zoning ordinances to designate a tract as a planned development district, the city clerk shall transmit in recordable form a facsimile copy of the plan and a certified copy of the amendment of the zoning ordinance and any other action taken thereon by the common council to the department of city development for recording in the office of the register of deeds. Recording fees shall be paid by the applicant.)

 

Part 4. Section 295-814-5 of the code is renumbered 295-814-4.

 

Part 5. Section 295-815 of the code is amended to read:

 

295-815. Issuance of Building Permits. No building permits may be issued and no site work may [[commence]] >>be commenced<< until [[after an approved]] >>a<< detailed plan has been [[recorded]] >>approved by the common council and a copy of the ordinance has been certified by the city clerk<<. Existing buildings located in a general planned development may receive building permits if the permits are for building modifications which do not include the addition of more usable floor space area or the establishment of uses not permitted by the development. >>Exterior site improvements in an approved general plan may receive building permits if the improvements have been shown in detail on the approved general plan and the "Project Description and Owner's Statement of Intent" indicates that early building permits would be sought for such improvements.<<
