Title
Resolution authorizing the Commissioner of Public Works to execute Project Agreements with the Wisconsin Department of Transportation for projects funded by The American Recovery and Reinvestment Act of 2009.
Analysis
The Wisconsin Department of Transportation (WISDOT) is soliciting applications for highway, bridge and transportation enhancement projects under The American Recovery and Reinvestment Act of 2009 (ARRA). The projects selected for the ARRA will be funded 100 percent by these federal funds. A list of the projects which the Department of Public Works is applying for is attached to this resolution. In order to meet the timelines of this program, there will not be sufficient time for the Department of Public Works to bring the project agreements for consideration by the Common Council. This resolution authorizes the Commissioner of Public Works to execute the project agreements as soon as they are received from the WISDOT.

Whereas, The United States Congress has passed and President Obama has signed into law The American Recovery and Reinvestment Act of 2009 (ARRA); and
Whereas, The appropriation for highways under the ARRA is administered by the Federal Highway Administration (FHWA); and
Whereas, The FHWA has assigned the administration of the highway appropriation to the Department of Transportations of the individual 50 states; and
Whereas, The Wisconsin Department of Transportation (WISDOT) is soliciting applications for highway, bridge and transportation enhancement projects under the ARRA; and
Whereas, The Department of Public Works intends to apply for those projects indicated on the list attached to this resolution; and
Whereas, Projects selected for the ARRA will be funded 100 percent by these federal funds; and
Whereas, The City of Milwaukee could be responsible for costs incurred on design activities if the preliminary engineering is not complete by December 1, 2009; and
Whereas, The timelines that the FHWA and WISDOT have imposed on the project development makes it impractical to seek Common Council authority to enter into the project agreements after they have been submitted to the City of Milwaukee; and
Whereas, Since the ARRA projects are in addition to the normal capital paving program, the Department of Public Works may engage consultants to undertake the preliminary engineering on the ARRA projects; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is authorized to execute the project agreements for projects funded by the ARRA, as soon as they are received from the WISDOT; and, be it
Further Resolved, That a list of successful projects will be transmitted to the Common Council once they are known.
