Analysis

Substitute resolution authorizing and directing the proper City officials to execute the Miller Park Traffic Control Easement Agreement and authorizing and directing the Commissioner of Public Works to let construction contracts for the Canal Street Miller Park Reversible Lanes/VMS Project.

Body

Whereas, The Department of Public Works (DPW) has developed a traffic control plan for the Miller Park South and East Access roads to facilitate two-way traffic and efficient stadium parking lot operations on the Miller Park South Access Road during stadium events upon completion of the Canal Street Extension; and

 

Whereas, The traffic control plan includes minor roadway geometric improvements, six overhead sign structures, a variable message sign, static signage, pavement markings, Intelligent Transportation System (ITS) equipment, and other items to allow reversible lane operation; and

 

Whereas, A portion of the traffic control plan will be implemented on the Miller Park South and East Access roads, which are under the jurisdiction of the State of Wisconsin Building Commission (State), who leases the lands to the Southeast Wisconsin Professional Baseball Park District (SEWPBPD) who, in turn, subleases the lands to the Milwaukee Brewers Baseball Club, Limited Partnership (Milwaukee Brewers); and

 

Whereas, The SEWPBPD and the Milwaukee Brewers participated in the development of and have approved the traffic control plan; and

 

Whereas, Common Council Resolution Number 030453 approved the plat of right-of-way required for the improvement of W. Canal Street between N. 6th Street and Miller Park and authorized acquisition of lands or interests in lands as shown on the approved plat of right-of-way for W. Canal Street; and

 

Whereas, Common Council Resolution Number 031256 authorized and directed the Commissioner of Public Works and/or City Engineer to negotiate and execute agreements necessary to accomplish construction of the W. Canal Street project; and

 

Whereas, The City Attorney's office and DPW have negotiated the Miller Park Traffic Control Easement Agreement between the City, State and SEWPBPD, and Milwaukee Brewers to allow the City to construct, own, and maintain portions of the traffic control equipment; and

 

Whereas, The City shall implement the traffic control plan at the City's expense through funding under existing Canal Street accounts as authorized in Common Council Resolutions 050563,  041405, 041034, 041234, 041466, 041237 and 040944 (local share); and

 

Whereas, The Wisconsin Department of Transportation (WISDOT) has agreed to provide $40,000 in CMAQ funds dedicated to Marquette Interchange traffic mitigation for the variable message sign component of Miller Park Traffic Control Plan and has submitted a Federal/State/Project Sponsor Transportation CMAQ Program Project Agreement for the variable message sign to be located at 25th and Canal to the City for execution; and

 

Whereas, Total construction costs for the traffic control plan are estimated at $350,000, which includes $280,000 for contract costs and $70,000 for construction engineering; and

 

Whereas, The overall cost of $22.85 M as last reported for the paving of the West Canal Street extension project included this traffic work and has not changed; and

 

Whereas, Future operation, repair, maintenance, and replacement costs for the traffic control equipment shall be shared 75% by the City and 25% by the Milwaukee Brewers; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby authorized and directed to execute The Miller Park Traffic Control Easement, a draft copy of which is attached to Common Council File Number 051014, and is incorporated by reference as though set forth in full; and, be it

 

Further Resolved, That minor changes to the draft Miller Park Traffic Control Easement Agreement, which do not change the general intent of the agreement are hereby approved; and, be it

 

Further Resolved, That the Commissioner of Public Works is hereby authorized and directed to execute the Federal/State/Project Sponsor Transportation CMAQ Program Project Agreement for construction of the variable message sign component of the Miller Park Traffic Control Plan with Federal/State aid, a draft copy of which is attached to Common Council File Number 051014, and is incorporated by reference as though set forth in full; and, be it

 

Further Resolved, That minor changes to the Federal/State/Project Sponsor Transportation CMAQ Program Project Agreement, which do not change the general intent of the agreement, are hereby approved; and, be it

 

Further Resolved, That the Commissioner of Public Works is authorized and directed to let construction contracts for the Canal Street Miller Park Reversible Lanes/VMS project.
