Resolution releasing certain deed restrictions related to the October 1993 conveyance of the property at 2118 West McKinley Avenue, in the 15th Aldermanic District.

This resolution releases deed restrictions placed on a property at the time of sale on October 7, 1993, to be recorded at the register of deeds.
Body
Whereas, The City of Milwaukee (“City”) previously owned a vacant lot property known as 2114 West McKinley Avenue, now combined and known as 2118 West McKinley Avenue (“The Property”); and
Whereas, The City sold The Property previously on October 7, 1993 to Ann Properties Limited with a quit claim deed that contained certain restrictions (Recorded document number 06861368 at the Milwaukee County Register of Deeds); and
Whereas, The 1993 quit claim deed imposed restrictions that The Property be combined with the buyer’s property, and that the property could not be divided from the buyer’s property without the approval of the Common Council of the City of Milwaukee; and
Whereas, The current owner of the combined property at 2118 West McKinley Avenue is Alfonzo Dupree; and
Whereas, Mr. Dupree has approached The Department of City Development asking for this restriction to be removed so that he may sell a portion of his combined lot to the adjacent owner to the East at 1315 North 21st Street; and
Whereas, The Department of City Development does not object to the proposed land transfer; and
Whereas, The local Alderperson is supportive of the removal of this deed restriction so that the land transfer may occur; and
Whereas, To facilitate this transfer, Alfonzo Dupree must have the deed restrictions from the 1993 deed waived by the Common Council; now, therefore, be it
Resolved; By the Common Council of the City of Milwaukee; that the proper City officials are authorized to execute all documents necessary to release the deed restrictions prescribed in the 1993 deed; and, be it
Further Resolved, That the proper City officials are authorized to execute all other documents necessary to accomplish the intent of this resolution.
