City of Milwaukee, Case No. 97-CV-0009822.
BODY
Whereas, FN 961945 adopted on 10/7/97 appropriated $10,000 from the Outside Counsel/Expert Witness Fund Special Purpose Account to hire outside counsel Fuchs, Snow, O'Connell & DeStefanis, S.C. for the purpose of bringing an action against the City of Milwaukee for alleged contributions due and owing the Policemen's Annuity & Benefit Fund in Policemen's Annuity & Benefit Fund v. City of Milwaukee, Case No. 970CV-0009822; and
Whereas, The entire amount of funding in the Outside Counsel/Expert Witness Fund Special Purpose Account has been appropriated for various cases and additional funding from the Contingent Fund is necessary; and
Whereas, Billings by Fuchs, Snow, O'Connell & DeStefanis, S.C. through July total $9,431.30 and there is a remaining balance of only $568.70 of the original $10,000 appropriation; now, therefore, be it
Resolved, That the sum of $5,000 be appropriated from the Common Council Contingent Fund (09-910-8000) to the Outside Counsel/Expert Witness Fund Special Purpose Account (01-023-8001) and to the City Attorney's Office Account (01-023-8002) for the purpose of paying the legal fees of Fuchs, Snow O'Connell & DeStefanis, S.C. for representing the Policemen's Annuity & Benefit Fund at an hourly rate not to exceed $90.00 in Policemen's Annuity & Benefit Fund v. City of Milwaukee, Case No. 97-CV-0009822; and, be it
Further Resolved, That such sums to be expended upon authorization from the City Attorney and the receipt of itemized statements at an hourly rate not to exceed $90.00 and that the application of the funds appropriated herein to a case other than that specifically referred to herein shall be subject to the further direction of the Common Council.
