Substitute Resolution authorizing and directing the Commissioner of Public Works to execute a revised project agreement with the Wisconsin Department of Transportation for the programming and construction of the improvement of West Canal Street between North 25th  Street and North 6th Street with Federal and/or State Aid. 

Analysis

This substitute resolution authorizes and directs the Commissioner of Public Works to execute a revised Project Grant Agreement with the Wisconsin Department of Transportation for the programming and construction for the improvement of West Canal Street from North 6th Street to North 25th Street.  The grant agreement provides for the preliminary and final design work for the project to be undertaken with $2.5 million of State funds.  The remaining engineering cost will be the responsibility of the City of Milwaukee.  This substitute resolution also authorizes the WISDOT to set off and withhold $10 million from the City from future General Transportation Aids (GTA) payments if the City fails to comply with the conditions of the Grant Agreement.

Body

Whereas, Common Council Resolution File Number 010651, adopted September 23, 2001, authorized and directed the Commissioner of Public Works to execute a Project Agreement with the WISDOT to allow us to undertake preliminary engineering work for the extension and improvement of West Canal Street between Miller Park and North 6th Street with Federal/State aid and authorized the establishment of the preliminary engineering subaccounts for the project; and

 

Whereas, The Project Agreement included in Resolution File Number 010651 was not executed by the WISDOT due to the WISDOT's requirements regarding the City's financial commitment to the project; and

 

Whereas, Common Council Resolution File Number 011360, adopted February 12, 2002, subsequently restated the City's support of the proposed improvement of West Canal Street and obligated the City to include any costs beyond those already committed for the City's share of the project in the City's 2003 Capital Budget; and

 

Whereas, WISDOT has additionally requested that as a precondition to the grant for the project that the City authorize them to set off and withhold $10 million otherwise due and payable by the WISDOT to the City from future General Transportation Aids (GTA) payments to the City; said amount intended to be withheld only if the City fails to comply with the conditions of the grant agreement; and

 

Whereas, The State Budget finalized the State's share of funds for this project; and

 

Whereas, The City may extend West Canal Street west of North 25th Street to provide a connection to USH 41 (Miller Parkway), that work is not eligible for the $10,000,000 direct grant for the reconstruction of West Canal Street authorized by 2001 Wisconsin Act 16; and 

 

Whereas, WISDOT has, therefore, provided a new Project Grant Agreement to now include all phases of the West Canal Street improvement project (preliminary engineering, final design, real estate, utilities, construction, railroad work and traffic control) and have submitted said revised Agreement to the City for execution; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee that the Commissioner of Public Works is hereby authorized and directed to execute the Project Grant Agreement with the WISDOT for the programming and construction of the improvement of West Canal Street between North 25th Street and North 6th Street with Federal/State aid, a draft copy of which is attached to Common Council Resolution File Number 020228, and is incorporated in this resolution by reference as though set forth in full; and, be it

 

Further Resolved, That the City authorizes the WISDOT to set off and withhold $10 million otherwise due and payable by the WISDOT to the City from future General Transportation Aids (GTA) payments to the City; said amount intended to be withheld only if the City fails to comply with the conditions of the grant agreement; and, be it

 

Further Resolved, That this Resolution supercedes Resolution File Number 010651, aforementioned above; and, be it

 

Further Resolved, That minor changes to the draft Project Grant Agreement which do not change the intent of the Agreement are hereby approved; and, be it

 

Further Resolved, That the Commissioner of Public Works is hereby authorized and directed to undertake or engage a consultant to undertake preliminary and final engineering for the aforementioned project; and, be it

 

Further Resolved, That the Commissioner of Public Works is authorized and directed to let contracts for any associated preliminary and final engineering or construction related work associated with this project; and, be it

 

Further Resolved, That the Commissioner of Public Works is hereby authorized and directed to enter into an agreement with the WISDOT pertaining to the cost participation for the installation and/or modification of traffic control facilities and street lighting facilities in conjunction with the improvement of the aforementioned project; and, be it

 

Further Resolved, That the Commissioner of Public Works is hereby authorized and directed to install the traffic control and street lighting facilities necessary in conjunction with the aforementioned project, following the execution of the traffic control and street lighting agreements, the cost of which will be included in future resolutions; and, be it

 

Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvement Fund, Grant and Aid Projects, the necessary Project/Grant Chartfield Values for preliminary and final engineering for the project (Expenditure and transfer to any of these accounts the amount required under the grant agreement and City Accounting Policy but not to exceed a 10 percent increase of the total amounts reserved for the grantor's share and local share, or $5,000, whichever is greater), as follows:
