Analysis
This substitute resolution will result in the sale of twenty vacant, City-owned and/or tax-deed lots for residential development.

Whereas, Midtown Neighborhood Association ("MTNA") has offered to purchase the following vacant, City-owned and/or tax-deed lots for $1.00 each:

Whereas, MTNA proposes to develop the block bounded by North 26th, North 27th, West Lloyd Streets and West Garfield Avenue with new residential construction for sale to qualified owner-occupants; and
 
Whereas, The Department of City Development ("DCD") recommends acceptance of said Offer from MTNA, contingent upon site and building plan approval by its Planning Division; and
 
Whereas, Said lots are being sold in an "as is" condition and the City of Milwaukee makes no representations as to soil or subsoil condition; and
 
Whereas, The City Plan Commission has determined that said lots are surplus to municipal needs; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that said lots are declared surplus, that the Offer from the Midtown Neighborhood Association is accepted, that the Commissioner of DCD, or assigns, is authorized and directed to perform such acts as necessary to carry out the intent of this resolution and that the proceeds from the sale be credited to the Reserve For Tax Deficit Fund Account and/or the Non-Tax-Deed Property Account; and, be it
 
Further Resolved, That in the event MTNA fails to close on the sale of said lots, the City of Milwaukee is authorized to assemble and sell buildable lots for development of owner-occupied housing and that no further action by the Common Council is required.
