This resolution will allow the construction of a storm sewer lateral and manhole in the City of Milwaukee right-of-way in North Faulkner Road south of West Dean Road to serve the property located at 8625 North Faulkner Road.
 
 
BODY:
Whereas, Storm sewers in North Faulkner Road south of West Dean Road were constructed to serve parcels 1 and 2 of Certified Survey Map No. 5246(CSM No. 5246); and
 
Whereas, These two parcels have been redivided into Parcels 1,2 and 3 of CSM No. 5728; and
 
Whereas, The storm sewer fronting Parcel 2 of CSM No. 5728 (8625 North Faulkner Road) on the north side is not capable of accepting the storm flow from this property; and
 
Whereas, The owner of said Parcel 2 is required to connect to the City of Milwaukee storm sewer; and
 
Whereas, The owner of said Parcel 2 requested that the City of Milwaukee allow the construction of new manhole and storm sewer lateral in City right-of-way to connect said Parcel 2 to the existing storm sewer manhole located south of the south line of said property; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the owner of Parcel 2 of CSM No. 5728, 8625 North Faulkner Road, is granted permission to construct a new manhole approximately 820 feet south of the south line of West Dean Road and a storm sewer lateral extending into and through City of Milwaukee right-of-way in North Faulkner Road from said manhole to the existing storm sewer manhole located approximately 920 feet south of the south line of West Dean Road under the following conditions:
 
1.      That construction plans for the building storm sewer lateral and manhole shall be submitted to the City Engineer for review prior to construction.
 
2.      That all work done in connection with building storm sewer and manholes must be done in conformance with the rules and regulations of the Milwaukee Metropolitan Sewerage District (MMSD), City of Milwaukee Plumbing Code and State of Wisconsin Plumbing Code.
 
3.      That all work shall be done at no cost to the City of Milwaukee.
 
4.      That the property owner shall require the contractor to obtain a permit for excavating in a public right-of-way and other applicable permits from the Commissioner of Public Works of the City of Milwaukee prior to commencing work within the public right-of-way.
 
5.      That the trench backfill and resurfacing shall be completed in accordance with the requirements of the City of Milwaukee.
 
6.      That written notice shall be given by the plumbing contractor to the City of Milwaukee's Sewer Maintenance Staff three (3) days prior to making connections to the City of Milwaukee sewers.
 
7.      That the property owner of said Parcel 2 shall be responsible for the maintenance of the storm sewer lateral in the public right-of-way, the new manhole and the connection to the existing manhole.
 
;and, be it
 
Further Resolved, That should the City of Milwaukee extend service of the storm sewer from the existing manhole south of the south line of said Parcel 2 to north of the south line of said Parcel 2, the building storm sewer lateral would be reconnected at no charge to the property owners; and be it
 
Further Resolved, That a certified copy of this resolution be forwarded to the property owner.
