Analysis
This ordinance makes various changes in the city code for the implementation of the 2004 city budget.  The ordinance increases fees for selected licenses, permits and forfeitures. The ordinance also incorporates technical changes throughout the code necessitated by the reorganization of the department of administration.  The ordinance takes effect January 1, 2004.
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
 
Part 1.  Section 60-3-1, 3 and 4 of the code is amended to read:
 
60-3.  Animal Fancier Permit and Fees.
1.  The fee for each animal fancier permit shall be [[$26]]>>$30<<.
3.  There shall be an additional [[$15]]>>$17<< late fee for any new or renewal permit application and fee that is received by the department later than the fifth day after the applicant has received the permit application.
4.  A [[$20]]>>$22<< delayed inspection fee shall be charged whenever a permit holder fails to schedule and allow a department inspection of the premises as provided in s. 78-7-2-b-2.  
 
Part 2.  Section 60-5-1 of the code is amended to read:
 
60-5.  Animal Impoundment Fee.
1.  The basic fee for the repossession of an impounded animal shall be [[$20]] >>$25<<.
 
Part 3.  Section 60-9-1 and 2 of the code is amended to read:
 
60-9.  Asbestos Project Permit.
1.  Review and inspection of permit application: [[$50]]>>$70<<.
2.  a. For a period not exceeding 3 days of asbestos project work: [[$100]]>>$135<<.
b. For a period of 4 to 10 days of asbestos project work: [[$200]]>>$270<<.

3.  Each permit shall be renewed annually upon the payment of the required fee before February 1 of the following year. There shall be an additional fee for the filing of a late renewal application in the amount of [[$7]]>>$25<<.
 
Part 8.  Section 60-19-1-a and 3-a of the code is amended to read:
 
60-19.  Dumping Permits.
1.  a.  The fee for each dump site permit under s. 80-45 shall be [[$142]]>>$145<<.
3.  a.  The fee for a private operator to dump snow at any of the city's snow dump sites shall be [[$101]]>>$145<<.
 
Part 9.  Section 60-20-2 of the code is amended to read:
 
60-20.  Filling Station License.

Part 10.  Section 60-20-3 of the code is created to read.
 
3.  There shall be an additional $25 fee for the filing of a late renewal application.

5.  The yearly fee for a meal service permit shall be $15 per site.

a.  The fee for each vehicle tank and bulk plant meter license shall be [[$71]]>>$75<<.
 
Part 29.  Section 60-91-7 of the code is created to read:
 
7.  VEHICLE SCALE OPERATOR'S LICENSE.  Vehicle scale operator's licenses, permits or registration certificates shall be issued for a one-year period commencing on July 1 and ending on the following June 30.  Effective January 1, 2005, each vehicle operator's license, permit or registration certificate shall be issued for the calendar year.
a.  Public Vehicle Scale Operator's License.
a-1.  Effective January 1, 2005, each public vehicle operator's license shall be $164.
a-2.  The fee for each public vehicle scale operator's license issued for the period July 1 2003, to June 30, 2004, shall be $164.  For the period July 1, 2004, to December 31, 2004, a prorated fee of $82 shall be paid for said license.
b.  "Type I" Nonpublic Vehicle Scale Operator's.
b-1.  Effective January 1, 2005, the permit fee for each "Type I" nonpublic vehicle scale operator's permit shall be $121.
b-2.  The fee for each nonpublic vehicle scale operator's permit issued for the period July 1, 2003, to June 30, 2004, shall be $121.  For the period July 1, 2004, to December 31, 2004, a prorated fee $60.50 shall be paid for said permit.
c.  "Type II" Nonpublic Vehicle Operator's Registration Certificate.
c-1.  Effective January 1, 2005, the fee for each "Type II" nonpublic vehicle scale operator's registration certificate shall be $121.
c-2.  The fee for each nonpublic vehicle operator's registration certificate issued for the period July 1, 2003, to June 30, 2004, shall be $121.  For the period July 1, 2004 to December 31, 2004, a prorated fee of $60.50 shall be paid for said certificate.
d.  Late Fee.  There shall be an additional fee for the filing of a late renewal application on or after July 1, 2004, and on or after January 1 of each year thereafter.
e.  Duplicates.  The fee for a duplicate license, permit or certificate specified in this subsection shall be $6.
 
Part 30.  Section 68-4.6-1 of the code is amended to read:
 
68-4.6.  Meal Service Permit.
1.  The application is fully and accurately completed and is accompanied by the fee set forth in [[s. 60-59]] >>s. 60-21-9<<.
 
Part 31.  Section 69-1-20 of the code is repealed.
 
Part 32.  Section 69-1-21 to 29 is renumbered 69-1-20 to 28.
 
Part 33.  Section 69-2-1-b of the code is repealed.
 
Part 34.  Section 69-2-1-c and d is renumbered 69-2-1-b and c.
 
Part 35.  Section 80-48-6 of the code is created to read:
 
80-48.  Rat Control Regulations.
6.  ELIMINATION OF RAT INFESTATIONS.  Not less than 24 hours after the mailing or service and posting of an order and notice to eliminate a rat infestation, if the rat infestation has not been eliminated, the commissioner may have the rats exterminated at the city's expense.  The costs of such action may be collected from the owner of the premises on which the rat infestation had existed or may be charged against the premises and assessed and collected as a special tax, upon notification by the commissioner to the city treasurer.
 
Part 36.  Section 80-66-4 of the code is created to read:
 
80-66.  Variance Permit.
4.  FEE.  No application for a variance permit under this section shall be considered by the commissioner unless the applicant has paid to the commissioner the permit fee required in s. 60-66.
 
Part 37. Section 81-2-2 of the code is amended to read:
 
81-2. Alarm Business License.

Part 62.  Section 81-52 of the code is amended to read:
 
81-52.  Fire Department Instruction and Training.  The fee for out-of-city personnel to attend training courses sponsored by the fire department shall be computed at the rate of [[$73]] >>$100<< per day, per person.
 
Part 63.  Section 81-52.5 of the code is amended to read:
 
81-52.5. Fire Service.  The fee for every unit of fire department equipment requested in excess of reciprocal fire service agreements entered into with other municipalities shall be [[$4,854]] >>$5,000<< per hour or fraction thereof.  The charges shall be computed from the time the equipment leaves its assigned quarter until the time such equipment returns to service in its assigned quarter.
 
Part 64.  Section 81-52.7 of the code is amended to read:

d.  Expenditure of contribution funds must be for the purpose or purposes specified by the donor.  Expenditure for a different purpose shall require approval of the donor and acceptance by the common council, relevant common council committee or the department of administration-budget and [[management]] >>policy<< division, as appropriate.
 
Part 146.  Section 304-24-7-a of the code is amended to read:
 
7.  DOCUMENTATION.  a.  When contributions are deposited in a trust account, the affected department shall prepare a plan for expenditure of the funds within one year of their receipt.  This plan shall be submitted to the department of administration-budget and [[management]] >>policy<< division, with a copy provided to the city comptroller.
 
Part 147.  Section 304-81-7-d-2 is amended to read:
 
304-81.  Grant Projects and Programs.
7.  BUDGET MODIFICATIONS AND COSTS OVERRUNS AND DISALLOWED COSTS.
d-2.  If expenditures charged to a major street and bridge improvement grant exceed the amount authorized by 10% of the total cost or $5,000, whichever is greater, the administering city department shall request additional authorization from the budget and [[management]] >>policy<< division in accordance with s. 18-10-6, city charter.  The city comptroller is authorized and directed to make the approved transfers.
 
Part 148.  Section 304-91-4 of the code is amended to read:
 
304-91.  Expenditure of Funds to be Reimbursed by Greater than Anticipated Revenues.
4.  DOCUMENTATION.  Prior to introduction of a resolution referenced in sub. 3, city departments requesting expenditure authority for reimbursable expenditures shall submit documentation in support of estimates for expenditure and greater than anticipated revenues to the budget and [[management]] >>policy<< division and provide copies to the comptroller.
 
Part 149.  Section 310-1-8 and 9 of the code is being repealed: (Note: The provisions being repealed read as follows:
 
310-1.  Department Established.
8.  Equal rights enforcement.
9. Equal opportunities enterprise program.)
 
Part 150.  Section 310-1-8 is created to read:
 
8.  Emerging business enterprise program.
 
Part 151.  Section 310-1-10 of the code is renumbered 310-1-9.
 
Part 152.  Section 310-11 of the code is amended to read:
 
310-11.  Intergovernmental Relations.
1.  AUTHORITY.  The division of [[intergovernmental relations]] >>budget and policy<< shall have authority to make studies and investigation, to promote programs to attack the underlying problems which face the city and to provide information with respect to fiscal matters related to the securing of a greater share of state and federal funds and to do whatever may be required in promoting for the city a greater share of state and federal fund distributions.
2.  FUNCTIONS.  The division of [[intergovernmental relations]] >>budget and policy<< shall be under the direction and supervision of a [[legislative liaison]] >>budget and policy<< director.  The [[legislative liaison]] >>budget and policy<< director shall be authorized to represent the city before legislative bodies of both the federal government and the state of Wisconsin as well as other political subdivisions of this state, subject to provisions of s. 350-211.  The [[legislative liaison]] >>budget and policy<< director may confer with officials and representative of municipalities and of other political subdivisions of this state for the purpose of securing assistance and cooperation in effectuating the purpose and objectives for which the division is created.  The [[legislative liaison]] >>budget and policy<< director may carry on educational programs, communicate in writing and make personal appearances and perform such other duties and responsibilities as in the judgment of the [[legislative liaison]] >>budget and policy<< director shall be most beneficial to the accomplishment of the purposes and objective herein provided.  The [[legislative liaison]] >>budget and policy<< director shall from time to time as the director determines most appropriate or as directed by the mayor or the common council, submit reports with reference to the operations of this division.  It shall also be the duty and responsibility of the director to carry out programs wherever necessary to increase the city's share of federal and state contributed funds in accordance with proposals prepared from time to time by the director and approved by the common council.  Annual reports and recommendations shall be required of the director to be made to the common council.  
3.  COORDINATION.  The [[legislative liaison]] >>budget and policy<< director shall make recommendations to the common council and mayor, as the need arises, as to those matters relating to the underlying problems faced by the city and to fiscal equity, and as to applications for state and federal grants, which would benefit from cooperative action by the common council and mayor, with those officials responsible for applications for state and federal grants who are under the jurisdiction of the county board of supervisors, the board of school directors, the board of vocation and adult education, the city and metropolitan sewerage commissions, and the social evelopment commission of greater Milwaukee.
 
Part 153.  Section 350-189 of the code is repealed.
 
Part 154.  This ordiance takes effect January 1, 2004.
