Title

Substitute resolution authorizing the Department of Public Works to accept a gift from the Milwaukee Brewers Baseball Club for an asphalt hot box.

Analysis

This resolution authorizes the Department of Public Works to accept a monetary gift of $27,500 from the Milwaukee Brewers Baseball Club to fund an asphalt hot box for pothole repairs, Brewer decals for equipment, and stenciled Brewer logos on newly-filled pothole locations.

Body

Whereas, Section 304-24 of the Milwaukee Code of Ordinances regulates the receipt, appropriation, and expenditure of contributions received by the City; and

Whereas, The Milwaukee Brewers Baseball Club has offered the Department of Public Works (DPW) a monetary gift of $27,500 to purchase an asphalt hot box and to provide for nominal associated costs of public recognition of the Brewers, including equipment decals and limited roadway stenciling; and

Whereas, An asphalt hot box heats cold and hot mix asphalt, operates at a larger capacity than traditional pothole hot boxes, and has a recycling and reclaiming function that enables overnight reclamation of approximately 1.5 tons of stockpiled asphalt per unit; and

Whereas, The recycling and reclaiming function allows DPW to stockpile and reclaim asphalt at Field Headquarters, which reduces waste and provides crews with access to hot mix when the asphalt plant is not operating, thereby extending the season and hours during which pothole repairs can be performed; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Department of Public Works is authorized to accept a monetary gift in the amount of $27,500 from the Milwaukee Brewers Baseball Club to fund the purchase of an asphalt hot box and nominal associated recognition costs; and, be it

Further Resolved, That the Department of Public Works is authorized to affix Brewers decals to the equipment and to implement a one-time public recognition initiative consisting of 75 stenciled Milwaukee Brewers baseball logos at newly-filled pothole locations, provided that:

1. All decals and stencils conform to DPW specifications and applicable standards, including materials and placement, and are applied in locations and for durations determined by DPW to be appropriate for safety, visibility, and maintenance.

2. No stenciling shall occur on surfaces or in locations where it would conflict with traffic control devices, impair roadway safety, or breach state or local requirements.

3. Any recognition shall be modest, factual, and non-advertising in nature and may be removed or discontinued at the discretion of DPW for operational, safety, or policy reasons.

; and, be it

Further Resolved, That the City Comptroller is authorized and directed to establish the appropriate accounts to receive the gift, and to credit such funds to DPW for the acquisition of the hot box; and, be it

Further Resolved, That the Common Council expresses its sincere appreciation to the Milwaukee Brewers Baseball Club for this generous gift.
