Resolution authorizing the Commissioner of Public Works to execute an audit agreement with the State of Wisconsin Department of Transportation for work on Greywolf Private Main sanitary sewer in conjunction with the Zoo Interchange's 76th Street Bridge over IH 94 contract work.
Analysis
This resolution approves the entitled Agreement for Payment for Engineering Review and Construction Inspection for the Relocation or Replacement of Greywolf Private Main Sanitary Sewer Facilities Located on Private Held Land Required by Freeway Construction, and authorizes the Commissioner of Public Works to execute the agreement on behalf of the City of Milwaukee.
 
This agreement relates to utility work on Greywolf private main sanitary sewer necessitated by the rehabilitation of the Zoo Interchange work on the South 76th Street Bridge over IH 94 contract being undertaken by the Wisconsin Department of Transportation in 2013 State Project ID 1060-33-00/78.  This agreement provides generally for the City to be reimbursed from the State 100 percent of the City costs for all work on Greywolf private main sanitary sewer necessitated by the freeway rehabilitation project in accord with Wisconsin State Statute 84.295(4m).
 
This resolution also authorizes the Commissioner of Public Works to prepare and review plans and estimates for the Zoo Interchange utility work as necessary to accomplish the project. This resolution also authorizes the Comptroller to establish accounts as necessary to track the work and to submit invoices to the State of Wisconsin for work undertaken on this project as approved by the Commissioner of Public Works, for a total amount of $12,000.00, with a City share of $0.00.
Body
Whereas, The State of Wisconsin Department of Transportation has scheduled the reconstruction of the Zoo Interchange in the City of Milwaukee, Milwaukee County; and
 
Whereas, There will be work required on Greywolf private main sanitary sewer as a result of the design and construction inspection associated with the Zoo Interchange freeway work; and
 
Whereas, Wisconsin State Statute 84.295(4m) indicates that the Wisconsin Department of Transportation will pay 100 percent of the cost of alteration, rehabilitation and relocation of private main sanitary sewer with the responsible jurisdiction liable for zero percent of the cost; and
 
Whereas, In order for the City of Milwaukee to be reimbursed for the 100 percent share of the engineering review and construction inspection cost of Greywolf private main sanitary sewer alteration on the Zoo Interchange freeway work, the Wisconsin Department of Transportation requires the entering into Municipal Audit Agreement Number (521), in accord with relocation assistance policy; and
 
Whereas, The Wisconsin Department of Transportation has provided the City of Milwaukee with the necessary municipal audit agreements to facilitate reimbursement of City costs in the alteration of Greywolf private main sanitary sewer; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby authorized and directed to execute the Audit Agreement Number (521) for Greywolf private main sanitary sewer, attached to this resolution by reference as though set forth in full; and, be it
 
Further Resolved, That the Commissioner of Public Works is hereby authorized and directed to review and prepare plans as necessary to accomplish the required Greywolf private main sanitary sewer alterations associated with the Zoo Interchange freeway work and is authorized to allow Wisconsin Department of Transportation to include Greywolf private main sanitary sewer work in the Zoo Interchange freeway work contract associated with the Zoo Interchange State Project ID 1060-33-00/78; and, be it
 
Further Resolved, That the City Comptroller is hereby authorized and directed to create within the Capital Improvements Fund, Grant and Aid Projects, the necessary project grant chart field values for engineering and construction inspection for the project expenditure and transfer to any of these accounts the amounts required under the grant agreement and city accounting policy but not to exceed a 10 percent increase of the total amounts reserved for the grantors share and local share or $5,000.00, whichever is greater, as follows:
