Analysis
This resolution authorizes the City of Milwaukee’s consent to the sale of a portion of property located at 1131 North 24th Street and release of an existing deed restriction. The City of Milwaukee’s consent is required pursuant to a deed restriction placed on the property when the City of Milwaukee conveyed the property to the original buyer.
Body
Whereas, On March 24, 1987, the Redevelopment Authority of the City of Milwaukee (“City”) conveyed the property located at 1127-29 North 24th Street (“Property”) to Joseph Schuman, (the “Owner”) via Quit Claim Deed (“Deed”); and
Whereas, The Deed transferring the Property included a restrictive covenant consisting of a joiner covenant that is “binding on the grantee, its successors and assigns, to-wit: The above-referenced parcel shall be joined with the buyer’s adjoining property, described below, so as to create a single parcel to be used as a unit which cannot be divided without the approval of the Common Council of the City of Milwaukee;” and
Whereas, By that certain Deed dated March 24, 1987 and recorded with the Register of Deeds for Milwaukee County, Wisconsin on April 28, 1987 on Reel 2078, Image 1832 as Document Number 06050197, the City conveyed to Joseph Schuman certain real property situated in the City of Milwaukee, County of Milwaukee, State of Wisconsin, being Lot 14, in Block 271, in Hawley’s Subdivision No. 2, in the Northwest 1/4 of Section 30, Township 7 North, Range 22 East, and having an address of 1127-29 North 24th Street, Milwaukee, Wisconsin 53233; and
Whereas, The Owner did join the parcel at 1127-29 North 24th Street with the adjacent parcel at 1131-33 North 24th Street as established in the Deed with an address of 1131 North 24th Street; and
Whereas, the current owner at 1131 North 24th Street wishes to convey 4.2 feet of the adjoined parcel to the adjacent property owner at 1123 North 24th Street, Strong Blocks Real Estate, LLC (the “Buyer”) and has requested the City’s consent to the sale of a portion of the Property as required by the Deed; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee (“Common Council”), that it consents to the sale of a portion of the parcel located at 1131 North 24th Street from the current owner to the Buyer, or if the sale to the Buyer does not succeed, the Common Council consents to the sale of a portion of the parcel located at 1131 North 24th Street from the owner to another City-approved buyer upon the Department of City Development’s notification to and approval from the local district’s alderperson; and, be it
Further Resolved, By the Common Council of the City of Milwaukee, that it consents to release the restrictive covenant in the Deed; and, be it
Further Resolved, That the City Clerk, City Attorney and any other relevant City officials are directed to take whatever actions are necessary and execute all documents needed to release the restriction contained in the Deed.
