Title

Resolution approving the surplus declaration and sale of the City-owned library property at 6431 North 76th Street, in the 9th Aldermanic District.

Analysis

This resolution authorizes the surplus declaration and sale of City-owned library property according to the conditions in a Land Disposition Report pursuant to Section 304-49, Milwaukee Code of Ordinances.

Body

Whereas, The Milwaukee Public Library Board of Trustees (“the Board”) voted to designate as surplus the former Mill Road Library, located at 6431 North 76th Street (“Property”), at its meeting on October 27, 2020 and authorized the City of Milwaukee (“City”) to offer the property for sale; and

 

Whereas, The Milwaukee Public Library had the Property appraised and the Department of City Development (“DCD”) had the Property surveyed; and

 

Whereas, DCD listed the Property for sale by Request for Proposals until December 14, 2023 and no acceptable proposal was received; and

 

Whereas, DCD reduced the price and continued listing the Property on its website and MLS on a continuous basis until an acceptable proposal was received; and

 

Whereas, DCD received an acceptable proposal on September 18, 2024 from Fatimah Ayesh or its newly created entity or assignee (jointly referred to as “Buyer”) to purchase and redevelop the Property as summarized in a Land Disposition Report (“LDR”), copies of which are attached to this Common Council File; and

 

Whereas, The City Plan Commission (“CPC”) makes recommendations to the Common Council regarding the sale of land used for public facilities, and CPC provided its recommendation and approval of the surplus declaration at its meeting on December 2, 2024; and

 

Whereas, The Board approved DCD’s recommendation to sell the Property on November 26, 2024; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Land Disposition Report is approved and the Commissioner of DCD, or designee, is authorized to enter into a Purchase and Sale Agreement with the Buyer, or assignee, to close the transaction and to take such actions, as may be needed, to effectuate the terms of the Land Disposition Report and this resolution; and, be it

 

Further Resolved, That the sale proceeds, less sale and closing expenses and a five percent disposition fee to the Redevelopment Authority of the City of Milwaukee, shall be credited to the appropriate Library Fund.
