Passage of this ordinance will add one-half acre to the general plan site.
BODY:
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
 
Part 1. There is hereby added to the Milwaukee Code a new section to read:
 
Section 295-810(2)(a).0039.
 
(1) In accordance with the provisions of Section 295- 810(1) of the Milwaukee Code relating to the establishment of planned development districts, the Common Council of the City of Milwaukee herewith approves the first amendment to the general plan for a general planned development known as Sinai Samaritan Medical Center, a copy of which is attached to this File as Exhibit "A" which is on file in the Office of the City Clerk and made a part thereof as though fully set forth herein.
 
(2) The zoning map is hereby amended so as to change from Local Business (L/A/85) to General Planned Development (GPD), for a portion of the area bounded and described as follows:
 
Commencing at the point of intersection of the centerline of West Kilbourn Avenue and the centerline of North 11th Street; thence North along the centerline of North 11th Street to the centerline of West State Street; thence East along the centerline of West State Street to the centerline of the North-South Freeway (I- 43); thence Northerly along the centerline of the North-South Freeway (I-43) to the centerline of West Highland Avenue; thence West along the centerline of West Highland Avenue to the centerline of North 12th Street; thence South along the centerline of North 12th Street to the centerline of West State Street; thence West along the centerline of West State Street to the centerline of North 14th Street; thence South along the centerline of North 14th Street to the centerline of West Kilbourn Avenue; thence East along the centerline of West Kilbourn Avenue to a point 165.00 feet east of the east line of North 13th Street; thence South and parallel to North 13th Street to the southwest corner of Lot 4 in Block 193 in Survey and Subdivision Into City Lots of the North 30 Acres, a recorded subdivision in the Northeast 1/4 of Section 30 and the Northwest 1/4 of Section 29, Township 7 North, Range 22 East; thence East along the south line of said Lot 4 and Easterly extension thereof to the centerline of North 12th Street; thence South along the centerline of North 12th Street to a point on a Westerly extension of the south line of Lot 7 in Block 192 in said subdivision; thence East along the south line of said Lot 7 and Westerly extension thereof to a point 150.00 feet west of the west line of North 11th Street; thence North and parallel to North 11th Street to the centerline of West Kilbourn Avenue; thence East along the centerline of West Kilbourn Avenue to the centerline of North 11th Street and the point of commencement.
 
By this action, the Common Council herewith approves the first amendment to the general plan for a general planned development known as Sinai Samaritan Medical Center and amends the zoning map on a portion of the above described area from Local Business (L/A/85) to General Planned Development and redesignates the remainder as a General Planned Development (GPD).
 
(3) The requirements set forth in said amended general plan attached to this File as Exhibit "A" constitute the zoning regulations for the area contained in such planned development district herein described, except that construction shall not be permitted in any segment of said tract until a detailed plan prepared in accordance with Section 295-813(3) of the Milwaukee Code of Ordinances has been approved by the Common Council and the zoning ordinance is amended; except that improvements may be permitted to the extent that such improvements are shown in detail and included in the approved general plan.
 
Part 2. Any persons, firm, company or corporation owning, controlling, or managing any building or premises wherein or whereon there shall be placed or there exists anything in violation of the terms of this ordinance; or who shall build contrary to the plans or specifications submitted to and approved by the Commissioner of Building Inspection, or any person, firm, company or corporation who shall omit, neglect or refuse to do any act required in this ordinance shall be subject to the penalties provided in Section 200-19 of the Milwaukee Code of Ordinances.
 
Part 3. In accord with the provisions of Section 295- 814(4) of the Milwaukee Code, the City Clerk shall transmit a facsimile copy of the approved general plan and a certified copy of the action taken thereon by the Common Council in recordable form to the Department of City Development for recording of said plan and Common Council action in the Office of the Register of Deeds.
 
Part 4. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions thereof. The Common Council hereby declares that it would have passed this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases or other portions be declared void or invalid.
