Resolution authorizing the Commissioner of Public Works to execute a Reimbursement Agreement between the City of Milwaukee and the Milwaukee Metropolitan Sewerage District for the removal of an obstruction and relaying of storm sewer pipes along the Menomonee River located in the City of Milwaukee.

This resolution authorizes the Commissioner of Public Works to execute a Reimbursement Agreement between the City of Milwaukee and the Milwaukee Metropolitan Sewerage District for the removal of an obstruction and relaying of storm sewer pipes along the Menomonee River located in the City of Milwaukee.
Body
Whereas, Common Council File No 201437 authorized the City to enter into an agreement with the Milwaukee Metropolitan Sewerage District (“MMSD”) for design and construct a continuation of the floodplain levee and floodwall system started in Hart Park in Wauwatosa to just west of the U.S. Highway 175 overpass, including completion of the remaining gap in the levee and floodwall system from east of the North 59th Street and West State Street Pump Station to approximately North 50th Place (the “Project”); and
Whereas, MMSD’s construction staff and contractor discovered a large concrete obstruction in the City’s 18” storm sewer line upstream of its connection with P-line sewer installed as part of the Project; and
Whereas, The Project is currently at the stage of restoring pavement on West State Street near the impaired City sewer line, and it would conserve labor, equipment, and materials to relay the City’s storm sewer line before the surface restoration is complete; and
Whereas, MMSD has agreed to order its construction contractor to begin additional storm sewer relay work on behalf of the City; and
Whereas, The City agrees to reimburse the MMSD for the cost of the additional storm sewer replacements requested by the City; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the proposed Reimbursement Agreement is hereby approved; and be it
Further Resolved, the appropriate City officers and employees, including the Commissioner of Public Works, are hereby authorized to sign the reimbursement agreement, or one in substantially the same form and substance as submitted, and to undertake such acts as are required of the City thereunder or in furtherance thereof, to effectuate the reimbursement agreement and this resolution; and be it
Further Resolved, That any expenditure of City funds that may be necessary as a result of the City signing the Agreement will be brought forth for Common Council consideration and approval.
