Analysis
Currently, the code defines an "improperly registered motor vehicle" as a motor vehicle for which an application and payment for registration are current and complete, as reflected in the records of the Wisconsin department of transportation, but which does not display evidence of current registration or registration expiring within the preceding 30 days. The code also prohibits an improperly registered motor vehicle from being located upon public right-of-way and provides a forfeiture and penalty for violation of this prohibition.
This ordinance eliminates the definition and prohibition of improperly registered motor vehicles. With these changes, only an "unregistered motor vehicle" will be prohibited, where "unregistered motor vehicle" is defined as one not displaying valid registration plates, a temporary operation plate or other statutory evidence of registration for the vehicle's current registration period or for a registration period for the vehicle that expired within the immediately preceding 31 days, and for which the records of the Wisconsin department of transportation indicate that there is no current and complete application and payment for registration.

The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 101-24.7-1 and 2 of the code is repealed and recreated to read:
101-24.7. Unregistered Motor Vehicles.
1. DEFINITION. In this section, "unregistered motor vehicle" means any motor vehicle that is located upon any alley, street, highway, public way or thoroughfare and that is not displaying valid registration plates, a temporary operation plate, or other evidence of registration as provided under s. 341.18(1), Wis. Stats., for the vehicle's current registration period or for a registration period for the vehicle that expired within the immediately preceding 31 days. A motor vehicle for which an application and payment for registration are current and complete, as reflected in the records of the Wisconsin department of transportation, shall not be considered an unregistered motor vehicle.
2. PROHIBITED AND PENALTIES. No unregistered motor vehicle may be located upon any alley, street, highway, public way or thoroughfare within the city. The stipulated forfeiture provided in s. 101-34-2-j and the penalty provided in s. 101-34-7-j shall apply.
