Title
Substitute resolution accepting a payment from Utility Service Partners, Inc., for the City's participation in a service line warranty program.
Analysis
The Common Council approved a resolution to participate in the National League of Cities' Service Line Warranty program with the adoption of Common Council File Number 101142 on July 6, 2011. This program provides a homeowner with certain cash benefits if the homeowner's private residential sewer lateral fails for a variety of reasons. The program, administered by Utility Service Partners, Inc., provides the City with revenue in the form of a 10% royalty on all income from City resident subscriptions.
On October 11, 2011, the Common Council adopted File Number 110737 directing the placement of royalty payments in segregated revenue accounts of the Sewer Maintenance Fund (SMF) to be used solely for programs designed to assist resident landowners with replacement of faulty private laterals.
An additional payment in the amount of $57,634 has been presented to the City by Utility Service Partners, Inc., as a gift in recognition of the City's leadership efforts to make the program available to residents of urban communities across the nation.
This resolution directs that this additional new payment be accepted and placed with other royalty payments in these same segregated revenue accounts of the SMF for the same purposes.

Whereas, The City of Milwaukee approved participation in the National League of Cities' Service Line Warranty Program through adoption of Common Council File Number 101142 on July 6, 2011; and
Whereas, The Service Line Warranty Program contributes a 10% royalty for every resident that participates in the program; and
Whereas, The proceeds from the National League of Cities' Service Line Warranty Program are placed in a segregated revenue account within the Sewer Maintenance Fund for use in future programs designed to assist landowners in replacement of private laterals as directed Resolution File Number 110737, adopted October 11, 2011; and
Whereas, In addition to the payments provided to the City under the National League of Cities' Service Line Warranty Program originally negotiated with Service Line Warranties of America, an additional payment in the amount of $57,634 has been offered to the City by Utility Service Partners, Inc., as a gift in recognition of the City's leadership efforts in making the program available to residents of urban communities across the nation; and
Whereas, Acceptance of the gift offered by Utility Service Partners, Inc., does not change, alter or otherwise amend the previously approved agreement with Service Line Warranties of America; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the contribution of $57,634 from the Service Line Warranty Program shall be accepted and placed in previously segregated revenue accounts within the Sewer Maintenance Fund to be used solely for future programs designed to assist resident landowners with replacement of faulty private laterals; and, be it
Further Resolved, That the proper City officials are directed to take such action as necessary to implement this resolution.
