Resolution directing the Commissioner of Public Works to execute a document titled “Intergovernmental Agreement Relating to the Sharing of Costs for the 2022-2026 Congestion Mitigation and Air Quality program cycle for the Milwaukee County Beerline Trail Extension Between Milwaukee County and the City of Milwaukee” for the design and construction of the Beerline Trail Extension project.

Analysis

This resolution directs the Commissioner of Public Works to execute a document titled “Intergovernmental Agreement Relating to the Sharing of Costs for the 2022-2026 Congestion Mitigation and Air Quality program cycle for the Milwaukee County Beerline Trail Extension Between Milwaukee County and the City of Milwaukee” for the cost sharing of the design, construction, and construction engineering of the Beerline Trail Extension from the existing Beerline Trail at West Capitol Drive to West Olive Street (City), West Olive Street to City limit approximately 300 ft west of North Port Washington Road (County), City limit approximately 300 ft west of North Port Washington Road to City limit approximately 500 ft west of North Port Washington Road (City), City limit approximately 500 ft west of North Port Washington Road to City limit approximately 100 ft east of North Green Bay Avenue (County), and City limit approximately 100 ft east of North Green Bay Avenue to North 20th Street (City) in the 1st and 6th Aldermanic Districts with a total estimated cost of the project to be $1,818,550, with a grantor share of $1,454,840, and a local of $363,710, of which the City’s share is $316,392 and the County’s share is $47,318. This resolution also directs the City Comptroller to transfer funds for design at an estimated cost of $0 with an estimated City share of $(7,218) and a County share $7,218. This resolution also directs the City Comptroller to transfer funds for construction at an estimated cost of $1,536,600 with an estimated City Share of $267,220, a grantor share of $1,229,280, and a County share of $40,100.

Body

Whereas, Milwaukee County and the City of Milwaukee received grant funds from the Wisconsin Department of Transportation’s (WisDOT) Congestion Mitigation and Air Quality (CMAQ) grant program (WisDOT Project ID 2978-09-00/70); and

 

Whereas, The Department of Public Works shall notify the Common Council of the City of Milwaukee of project cost overruns and changes in scope approved by the Department of Public Works; and

 

Whereas, The Common Council of the City of Milwaukee recognizes that the City may be 100 percent liable for project cost overruns and changes in scope as approved by the Department of Public Works; and

 

Whereas, The right-of-way upon which the trail will be built is within the City of Milwaukee boundaries from West Capitol Drive to West Olive Street, the City limit approximately 300 ft west of North Port Washington Road to the City limit approximately 500 ft west of North Port Washington Road, and the City limit approximately 100 ft east of North Green Bay Avenue to North 20th Street; and

 

Whereas, The City of Milwaukee will be the lead agency of the project design and Milwaukee County will be the lead agency of the project construction; and

 

Whereas, This project is expected to be constructed in 2027; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public works is hereby authorized to execute a document titled “Intergovernmental Agreement Relating to the Sharing of Costs for the 2022-2026 Congestion Mitigation and Air Quality program cycle for the Milwaukee County Beerline Trail Extension Between Milwaukee County and the City of Milwaukee” for the cost sharing of the design, construction, and construction engineering of the Beerline Trail Extension from the existing Beerline Trail at West Capitol Drive to West Olive Street (City), West Olive Street to City limit approximately 300 ft west of North Port Washington Road (County), City limit approximately 300 ft west of North Port Washington Road to City limit approximately 500 ft west of North Port Washington Road (City), City limit approximately 500 ft west of North Port Washington Road to City limit approximately 100 ft east of North Green Bay Avenue (County), and City limit approximately 100 ft east of North Green Bay Avenue to North 20th Street (City) with a copy of which is attached to Common Council Resolution File Number 241856, and is incorporated by reference as though set forth in full; and, be it

 

Further Resolved, That minor changes to the intergovernmental agreement which do not change its intent are hereby approved; and, be it

Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvement Fund, Grant and Aid Projects, the necessary Project Grant Chartfield Values for design, construction, and procurement for the project (Expenditure) and transfer to any of these accounts the amount required under the grant agreement and City Accounting Policy but not to exceed a 10 percent increase of the total amounts reserved for the grantor’s share and local share or $5,000, whichever is greater, as follows:
