Analysis

To implement certain provisions of the 2006 city budget, this ordinance:

1.  Requires that owners and tenants of those properties serviced by the recycling collection system, where carts are left at the alley line or curb line after servicing, return the carts to their proper storage locations before 10 p.m. on the day they are serviced.  Failure to comply with this requirement following a written notice with respect to the alleged violation shall result in a special charge of $20, and the second and each subsequent failure to comply within a calendar year shall result in a special charge of $35.

2.  Increases the fee for an amusement machine permit (tag) from $20 to $25.

3.  Increases the fee for an amusement distributor’s license from $550 to $600.

4.  Increases the fee for a Class “A” fermented malt beverage retailer’s license from $250 to $350.

5.  Establishes a schedule of fees for preparation of traffic control plans for certain special events - $900 for plans requiring 12 or more hours for preparation, $600 for plans requiring 5 to 11 hours of preparation, and $240 for plans requiring 1 to 4 hours of preparation or revision of existing plans not exceeding 4 hours.

6.  Requires that any overpayment made by a property owner of a combined bill for the local sewer charge, storm water management charge, solid waste charge, and the snow and ice removal cost recovery charge be applied to the water bill for the property.

 

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1.  Section 79-32 of the code is created to read:

79-32.                      Return to Storage Location. Owners and tenants of those properties serviced by the recycling collection system, where carts are left at the alley line or curb line after servicing, shall return the carts to their proper storage locations before 10 p.m. on the day they are serviced.

 

Part 2.  Section 79-47-1-e of the code is created to read:

79-47.  Penalties, Liens and Citations.

1.  PENALTIES.

e.  Any person who fails to comply with s. 79-32 shall receive a written notice with respect to the alleged violation of s. 79-32.  Failure to comply following such notification shall result in a special charge of $20, and the second and each subsequent failure to comply within a calendar year shall result in a special charge of $35.

 

Part 3.  Section 81-4-2-c and d of the code is amended to read:

81-4.  Amusement Premises, Distributors, Machines and Videogame Centers.

2.  The following fees shall be Paid:

c.  Amusement machine permits (tag): [[$20]] >>$25<<.

d.  Amusement machine distributor’s license [[$550]] >>$600<<.

 

Part 4.  Section 81-22-1 of the code, as amended by File Number 050413, effective January 1, 2006, is amended to read:

Part 5.  Section 81-114.6-5-f of the code is created to read:

81-114.6.  Special Events - City Services.

5.  Provision of additional services:

f.  Traffic Control Plans.

f-1.  Plans requiring 12 or more hours of preparation: $900.

f-2.  Plans requiring 5 to 11 hours of preparation: $600.

f-3.  Plans requiring 1 to 4 hours of preparation or revision of existing plans not exceeding 4 hours: $240.

 

Part 6.  309-54-9-d of the code is amended to read:

309-54.                     Sewer-Related Charges.

9.  BILLING AND COLLECTING.

d.  Partial Payments.  When partial payments of the combined city services user bill are made, the property owner may direct in writing how the partial payment is to be applied to the combined bill.  If there is no written direction, the partial payment is to be applied to the water bill first.  Any portion of the partial payment remaining after the water bill is paid for shall be applied to the local sewerage charge, the storm water management charge, the solid waste charge and the snow and ice removal cost recovery charge, in that order.  Any overpayment of the combined bill shall be applied to the [[local sewerage charge]] >>water bill<< on the account for such property.

 

Part 7.  This ordinance takes effect January 1, 2006.
