Substitute resolution appropriating funds from the Outside Counsel/Expert Witness Fund Special Purpose Account for the purpose of retaining outside counsel.

-Analysis-
The Retirement Board of the Policemen's Annuity & Benefit Fund has adopted a motion to sue the City over contributions to the Policemen's Annuity & Benefit Fund. The Retirement Board has retained the firm of Fuchs, Snow, O'Connell & DeStefanis, S.C. to represent the Retirement Board and has requested the Common Council approve the Board's action and provide funds to pay its outside counsel in this matter. This resolution approves the Retirement Board's retention of Fuchs, Snow, O'Connell & DeStefanis, S.C. and authorizes an appropriation from the Outside/Expert Witness Special Purpose Account to the City Attorney's Office Account for this purpose. _________________________________________________________

Whereas, The Retirement Board of the Policemen's Annuity & Benefit Fund has voted to bring an action against the City relative to City contributions to the Policemens' Annuity & Benefit Fund; and
Whereas, The Retirement Board of the Policemen's Annuity & Benefit Fund has retained the firm of Fuchs, Snow, O'Connell & DeStefanis, S.C. for such purpose and has requested the Common Council to authorize funds to pay for such outside counsel; and
Whereas, The Outside Counsel/Expert Witness Special Purpose Account (01-023-8001) is to be used by the City Attorney's Office for the purpose of retaining the services of outside legal counsel; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the sum of $10,000 be and hereby is appropriated from the Outside Counsel/Expert Witness Special Purpose Account (01-023-8001) to the City Attorney's Office Account (01-023-8002) for the purpose of paying the outside counsel fees of the Retirement Board of the Policemen's Annuity & Benefit Fund and related expenses due and owing the firm of Fuchs, Snow, O'Connell & DeStefanis, S.C.; such sums to be expended upon authorization from the City Attorney and the receipt of itemized statements therefore; and, be it
Further Resolved, That the Retirement Board of the Policemen's Annuity & Benefit Fund be and hereby is authorized to retain the services of Fuchs, Snow, O'Connell & DeStefanis, S.C. at an hourly rate not to exceed $90.00 per hour for the purpose of bringing an action against the City of Milwaukee for alleged contributions due and owing the Policemen's Annuity & Benefit Fund.
