Minutes note: Fernando Aniban, HACM’s Assistant Secretary, explained the agreement between HACM and RACM is necessary as the U.S. Department of Housing and Urban Development (HUD) recently informed HACM that public housing authorities who manage vouchers cannot deploy its vouchers to properties it owns. Mr. Aniban stated that attorneys and auditors for both organizations reviewed the documents. Commissioners discussed the legalities of the amendment and if another alternative plan was discussed. Mr. Aniban stated that HACM approached the County with a proposal which is still being explored. Commissioner VandeBerg requested a report back to the Board with the final agreement documents.

Body

WHEREAS, the Housing Authority of the City of Milwaukee (“HACM”) was created for the purpose of providing quality housing for low-income families and individuals; and

 

WHEREAS, the Redevelopment Authority of the City of Milwaukee (“RACM”) was created for the purpose of carrying out blight elimination and urban renewal programs and projects; and

 

WHEREAS, the parties previously entered into an Intergovernmental Cooperation Agreement dated as of July 26, 2006, and an Amended and Restated Intergovernmental Corporation Agreement (Expanded HACM Activities) dated January 15, 2015, providing for the development of mixed-use properties and market-rate homes by HACM; and

 

WHEREAS, the parties desire to enter into a Second Amended and Restated Intergovernmental Cooperation Agreement in order to restate and expand the description of RACM’s activities hereunder in order to accommodate the transfer of certain real property owned by HACM to RACM pursuant to a separate Sale, Lease and Reconveyance Agreement in order to assure compliance with current United States Department of Housing and Urban Development (“HUD”) requirements referenced in HUD Notice PIH 2017-21 (HA) regarding certain voucher payments; and

 

WHEREAS, Wisconsin Statutes specifically provide, in sections 66.1201(9)(w) and 66.1333(5)(a)(9), for housing and redevelopment authorities to exercise each other’s powers when done by way of an Intergovernmental Cooperation Agreement and a Second Amended and Restated Intergovernmental Corporation Agreement will facilitate commercial, retail and other development to be undertaken or assisted by HACM and further allow RACM to take and hold title to certain HACM developments; and

 

WHEREAS, it will benefit and augment the low-income housing goals of HACM and the City of Milwaukee if RACM takes title to certain HACM developments to assure compliance with HUD requirements; and

 

WHEREAS, it will benefit and augment the redevelopment and economic development goals of RACM and the City of Milwaukee if HACM undertakes such commercial, retail and other development activity; now therefore, be it

 

RESOLVED, by the Housing Authority of the City of Milwaukee, that the proper officials are authorized to execute the attached Second Amended and Restated Intergovernmental Cooperation Agreement with HACM, which agreement may be modified in non-substantive ways prior to execution upon advice from the City Attorney and with approval of the Executive Director
