Resolution approving an agreement between the City of Milwaukee and the City of Chicago for the provision of Milwaukee Police Department law enforcement services at the Chicago 2012 North Atlantic Treaty Organization Summit.
Analysis
This resolution approves an Intergovernmental Cooperation Agreement between the City of Milwaukee and the City of Chicago relating to the provision of Milwaukee Police Department law enforcement services at the North Atlantic Treaty Organization summit to be held in Chicago on May 20 and 21, 2012. It also authorizes the Chief of Police to enter into this Intergovernmental Cooperation Agreement on behalf of the City.
Body
Whereas, On May 20 and 21, 2012, the City of Chicago, Illinois, will be hosting a North Atlantic Treaty Organization ("NATO") summit; and
Whereas, According to the Chicago 2012 NATO Summit website, the event is expected to bring nearly 10,000 people to Chicago, including more than 7,000 delegates and staff, along with about 2,000 international journalists; and
Whereas, The City of Chicago is in need of procuring additional law enforcement services to provide the public safety and security measures required for an event of the size and unique nature of the 2012 NATO Summit, and has requested the participation of the Milwaukee Police Department ("MPD") in providing these services; and
Whereas, The City of Milwaukee, through MPD, wishes to provide law enforcement services to the Chicago 2012 NATO Summit pursuant to the police powers and law enforcement authority granted under the laws of the State of Wisconsin and City of Milwaukee; and
Whereas, According to the Intergovernmental Cooperation Agreement between the City of Chicago and the City of Milwaukee, a copy of which is attached to and made a part of this file, MPD personnel may not and will not act with some or all of the arrest or other police authority of a law enforcement officer of any law enforcement agency in Illinois; and
Whereas, The City of Milwaukee will be reimbursed for time and expenses related to the provision of law enforcement services at the Chicago 2012 NATO Summit; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the attached Intergovernmental Cooperation Agreement between the City of Milwaukee and the City of Chicago relating to the provision of Milwaukee Police Department law enforcement services at the Chicago 2012 NATO Summit is approved; and, be it
Further Resolved, That the Chief of Police is authorized to enter into an Intergovernmental Cooperation Agreement that is in substantially the same form as the Intergovernmental Cooperation Agreement that is attached to this file; and, be it
Further Resolved, That those Milwaukee Police Department personnel selected for the provision of law enforcement services at the Chicago 2012 NATO Summit pursuant to the Intergovernmental Cooperation Agreement, acting under the direction and control of the Chief of Police, shall remain employees of the Milwaukee Police Department throughout the period of their services as part of this effort; and, be it
Further Resolved, That MPD personnel may not and will not act with some or all of the arrest or other police authority of a law enforcement officer of any law enforcement agency in Illinois; and, be it
Further Resolved, That MPD personnel selected for the provision of law enforcement services at the Chicago 2012 NATO Summit under the Intergovernmental Cooperation Agreement shall undergo training and fully participate in public safety and security operations with other police departments from throughout the United States; and, be it
Further Resolved, That MPD shall keep and maintain the appropriate books and records, as specified in the Intergovernmental Cooperation Agreement, of the salaries and other compensation earned by MPD personnel during the period of their service in conjunction with the Chicago 2012 NATO Summit, as well as all other verifiable "mission-related expenses" associated with their participation in this effort, and shall submit the completed Reimbursement Payment Form which is attached to this file to the City Comptroller for review at the conclusion of MPD's participation in this effort; and, be it
Further Resolved, That the Milwaukee Police Department shall submit the Reimbursement Payment Form, and other applicable documentation required pursuant to the Intergovernmental Cooperation Agreement, to the City of Chicago for reimbursement of the City of Milwaukee in accordance with the provisions of the Intergovernmental Cooperation Agreement; and, be it
Further Resolved, That the City Comptroller is authorized to:
1. Commit funds within the Project/Grant Parent of the 2012 Special Revenue-Grant and Aid Projects Fund for a project titled "Major Incident Response Team - Chicago 2012 NATO Summit":

2. Create the necessary Grant and Aid Project/Grant and Project/Grant levels and budget against these Project/Grant values the amounts required under the grant agreement.

Further Resolved, That these funds are budgeted for the Milwaukee Police Department, which is authorized to expend the funds for overtime and other expenses (e.g., transportation, food, etc.) related to the deployment of Milwaukee Police Department personnel to the Chicago 2012 NATO Summit; and, be it
Further Resolved, That the City's approval of the Intergovernmental Cooperation Agreement and execution of the agreement by the proper City officials is contingent upon approval of the Agreement by the Wisconsin Attorney General, as required by s. 66.0303, Wis. Stats.; and, be it
Further Resolved, That the proper City officials are directed to execute the Intergovernmental Cooperation Agreement in a timely manner upon Attorney General approval of the Agreement.
