Analysis

This ordinance defines the terms “escort service” and “tattooing or body-piercing establishment” for zoning purposes.  It also explicitly excludes “escort service” from the definition of “general office” and “tattooing or body-piercing establishment” from the definition of “personal service”.

In addition, this ordinance classifies escort services as special uses in the following zoning districts:  the RO1/RO2 residential and office districts, all commercial districts, all downtown districts, all industrial districts and the institutional districts.  It classifies tattooing or body-piercing establishments as special uses in the same zoning districts, with the exception of the C9H (Downtown-Warehousing and Light Manufacturing), IO1/IO2 (Industrial-Office), IL1/IL2 (Industrial-Light) and IH (Industrial-Heavy) districts, where these establishments would be prohibited uses.

This ordinance classifies both escort services and tattooing or body-piercing establishments as limited uses in the RS6 (Single-family Residential), RT4 (Two-family Residential) and RM3-RM7 (Multi-family Residential) zoning districts.  The limited use standards are as follows:

1.  The structure to be occupied was constructed prior to October 1, 2002.

2.  The structure was originally designed and intended to be occupied in whole or in part by a non-residential use.

3.  The structure has been continuously occupied by the non-residential use.

If the structure meets the first two standards, but not the third, the use shall be classified as a special use.  If the structure does not meet either the first or the second standard, the establishment shall be classified as a prohibited use.

In all other zoning districts, both escort services and tattooing or body-piercing establishments are classified as prohibited uses.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1.  Section 295-201-171.5 of the code is created to read:

295-201.  Definitions.

171.5.  ESCORT SERVICE means the place of business of an escort service, as defined in s. 89-1-2.  For purposes of this definition, “place of business” shall be the place of business set forth on the escort service license application.

Part 2.  Section 295-201-239 of the code is amended to read:

239.  GENERAL OFFICE means use of a building for business, professional or administrative offices.  A general office is characterized by a low proportion of vehicle trips attributable to visitors or clients in relationship to employes.  Examples include, but are not limited to, offices of firms or organizations providing architectural, computer software consulting, data management, engineering, interior design, graphic design, real estate, insurance, investment or legal services.  This term does not include a bank or other financial institution >>, an escort service<< or the office of a physician, dentist, optometrist or chiropractor.

Part 3.  Section 295-201-451 of the code is amended to read:

451.  PERSONAL SERVICE ESTABLISHMENT means an establishment providing services which are of a recurring and personal nature to individuals.  This term includes, but is not limited to, a barber shop, beauty salon, shoe repair shop, seamstress, tailor, fortune teller, tanning salon [[,]] >>or<< massage establishment [[, body piercing establishment or tattoo establishment]].  This term does not include a portrait studio, dry cleaning establishment, laundromat, photocopy center, health club >>, tattooing or body-piercing establishment<< or repair shop for household items.

Part 4.  Section 295-201-654 of the code is created to read:

654.  TATTOOING OR BODY-PIERCING  ESTABLISHMENT means an establishment licensed to provide tattooing or body piercing pursuant to s. 75-51.

Part 5.  Section 295-203-5-a of the code is amended to read:

295-203.  Use Definitions.
