Title

Substitute resolution authorizing the proper City officials to execute State Municipal Agreements with the Wisconsin Department of Transportation for the City of Milwaukee utility alterations in conjunction with the I-94 East West, West Leg (70th Street - Zablocki Drive) Reconstruction Project, at a total estimated cost of $149,282,198, with an estimated grantor share of $148,905,750 and an estimated City share of $376,448.

Analysis

This resolution authorizes the Commissioner of Public Works and the Comptroller to execute the State Municipal Agreements for construction alterations on Milwaukee Water Works, City Underground Conduit, City of Milwaukee Sanitary Sewer, and City of Milwaukee Communications facilities in conjunction with the I-94 East West, West Leg contract.  Total estimated cost of $149,282,198, with an estimated grantor share of $148,905,750 and an estimated City share of $376,448.

Body

Whereas, The Wisconsin Department of Transportation (WisDOT) has scheduled the reconstruction of the I-94 East West (70th Street - Zablocki Drive) in the City of Milwaukee; and

 

Whereas, The I-94 East West, West Leg (70th Street - Zablocki Drive) contract will include reconstruction of I-94, abutting frontage roads Kearney Street and O’Connor Street; 70th Street, 68th Street, and Hawley Road in the City of Milwaukee; and 

 

Whereas, Alterations to Milwaukee Water Works, City Underground Conduit, City of Milwaukee Sanitary Sewer, and City of Milwaukee Communications facilities are necessitated by the I-94 East West, West Leg; and

 

Whereas, Wisconsin Statue 84.295(4m) indicates that the Wisconsin Department of Transportation will pay 90% of the cost of alteration, rehabilitation, and relocation of Municipal utilities with the responsible jurisdiction liable for the remaining 10% of the cost; and

 

Whereas, In order for the City to be reimbursed for the 90% share of the utility alteration construction cost on the I-94 East West, West Leg contract, the Wisconsin Department of Transportation requires a State Municipal Agreement, in accord with WisDOT relocation assistance policy; and

 

Whereas, The Wisconsin Department of Transportation has provided the City with the necessary State Municipal Agreements to facilitate reimbursement of the City utility alteration construction costs associated with the I-94 East West, West Leg contract; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby authorized to execute the State Municipal Agreements for construction alterations on Milwaukee Water Works, City Underground Conduit, City of Milwaukee Sanitary Sewer, and City of Milwaukee Communications facilities in conjunction with the I-94 East West, West Leg contract, attached to this resolution by reference as though set forth in full; and, be it

 

Further Resolved, That the funding to cover the 10% City cost of the I-94 East West, West Leg contract utility alterations for the Milwaukee Water Works, City Underground Conduit, City of Milwaukee Sanitary Sewer, and City of Milwaukee Communications estimated to be $273,548, $87,347, $8,483.50, and $7,069.50 respectively, are or will be placed in Department of Public Works Departmental Accounts; and, be it

 

Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvement Fund, Grant and Aid projects, the necessary Project Grant Chartfield Values for engineering and construction for the projects (expenditure) and transfer to any of these accounts the amounts required under the grant agreement and City Accounting Policy but not to exceed a 10 percent increase of the total amounts reserved for the grantor's share and local share or $5,000, whichever is greater, as follows:
