Substitute resolution to approve construction of developer financed public improvement projects in Milwaukee Metro Center Phase I, in the 15th Aldermanic District.

This resolution authorizes a variance from Administrative Rules and construction of certain public improvements which are to be financed by a developer in accordance with an agreement previously approved by the Common Council.
BODY:
Whereas, On November 25, 1997, the Common Council of the City of Milwaukee adopted Resolution File Number 970112 approving construction of developer financed water main to support the Milwaukee Metro Center Phase I, located south of West Good Hope Road and east of US Highway 45, and is still valid, and
Whereas, On July 11 1997, the Common Council of the City of Milwaukee adopted Resolution File Number 970478 authorizing an agreement between the developer of Milwaukee Metro Center Phase I and the City of Milwaukee for the installation of required improvements in certain public ways:
W. Fond du Lac Ave. - 360 ft. m/l east of N. 107th St. to 175 ft. m/l west of N. 107th St. (960-1445-6) File Number 971331: Intersection modification, concrete pavement, replace curb and gutter, sidewalk and driveway approaches where needed, sodding, and grading. in the 15th Aldermanic District of the City of Milwaukee; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that a variance is authorized from the procedures of File Number 881665, being the Administrative Rules for the Capital Improvements Process, and hereby directs the City Comptroller to make a supplemental appropriation of $900,000 in the Sewer Developer Out-of-Program Capital Purpose Account (72-523---170-8000) with offsetting revenues in Sewer Estimated Revenue (72-523---170-9003); and, be it
Further Resolved, That the City Comptroller is hereby authorized to make the necessary funding and accounting entries, including increasing the Sewer Developer Out-of-Program Capital Purpose Account and offsetting revenues to appropriately reflect the intent of this action and assure adequate cost recovery.
Further Resolved, That after the developers of said development deposit the necessary funds in accordance with said agreement, the Commissioner of Public Works is authorized and directed to proceed with said work.
