Title

Resolution amending Common Council Resolution File Number 080563 relating to creation of a taxicab review board.

Analysis

This resolution amends Common Council Resolution File Number, adopted on September 16, 2008, relating to creation of a Taxicab Review Board to review taxicab charges, fares and regulation.  This amendment provides that a duly appointed member of the Review Board may identify a designee to serve on the Review Board in his or her absence.  The amendment further provides that members or designees need not be residents of the city as provided in s. 320-3 of the Code of Ordinances.

Body

Whereas, On September 16, 2008, the Common Council adopted resolution File Number 080563 relating to creation of a Taxicab Review Board to review taxicab charges, fares and regulation; and

 

Whereas, The Taxicab Review Board established in File Number 080563 Review Board is to consist of the following 7 members:

     1.                     One member of the Common Council to be appointed by the President of the Common Council.

                     2.                     One member of the public to be appointed by the President of the Common Council.

                     3.                     3 members representing the taxicab industry including: one to be designated by Yellow Cab Cooperative, one to be designated by American United Taxicab Services, and one independent driver to be appointed by the President of the Common Council.

                     4.                     One member to be designated by the President of the Greater Milwaukee Convention and Visitors Bureau (“Visit Milwaukee”).

                     5.                     One member to be designated by the Milwaukee County Transit System (MCTS)

Whereas, File Number 080563 is silent concerning the designation of alternates to serve in the absence of duly appointed Review Board members; and

 

Whereas, Section 320-3 of the Code of Ordinances provides that members appointed to boards of the City must be residents of the City unless the statute, ordinance or resolution creating the board specifies otherwise; and

 

Whereas, Furthermore, the Common Council finds that, to assure timely and effective deliberation by the Taxicab Review Board, it is necessary and appropriate to authorize Review Board Members to designate alternates to serve in their absence; and

 

Whereas, The Common Council finds that the regional characteristics of public passenger vehicle service, and the importance of including members on the Review Board who have special expertise and experience, makes it necessary to create an exception to the general residency requirements for board appointments consistent with s. 320-3 of the Code; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that resolution File Number 080563 be amended by inserting the following 2 additional clauses after the first “Resolved” clause to read:

 

“Further Resolved, That Members of the Taxicab Review Board need not be residents of the City of Milwaukee; and, be it

 

Further Resolved, That duly appointed members of the Taxicab Review Board may, upon written notice provided to the City Clerk more than 24 hours prior to a scheduled meeting of the Review Board, designate a person to act as an alternate in the absence of the Board Member, exercising such powers and fulfilling such duties as may be necessary and appropriate in the absence of the appointed Member; and, be it….”
