The Board of Business Improvement District No. 19 (Villard Avenue) has offered to join the City in a project to install and maintain sidewalk area streetscaping on West Villard Avenue between approximately North 29th and North 42nd Streets in the 1st and 9th Aldermanic Districts. This Development and Maintenance Agreement details the responsibilities of the City and the BID for the construction, maintenance, and financing of the project. In particular, it commits the BID to repay $237,500 in project costs, plus interest, to the City over a 15 year period.
BODY:
Whereas, The Common Council of the City of Milwaukee on September 23, 1997 via File No. 970778, created Business Improvement District No. 19 ("BID No. 19") and approved its first year Operating Plan; and
Whereas, The current Operating Plan for BID No. 19 calls for the BID Board to enter into an agreement with the City of Milwaukee ("City") for the financing, installation, and maintenance of a mutually acceptable streetscaping project for the portion of West Villard Avenue between approximately North 29th and North 42nd Streets; and
Whereas, A Development and Maintenance Agreement ("Agreement") for the project has been prepared with the participation of the Board of BID No. 19 and City departments; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the Development and Maintenance Agreement for Business Improvement District No. 19 (West Villard Avenue Streetscaping Project), a copy of which is attached to this Common Council File, is approved and the proper City officials are authorized and directed to execute the Agreement; and, be it
Further Resolved, That any non-substantive technical changes to the Agreement which the City Attorney, in consultation with the Commissioner of Public Works, may determine to be necessary and to be consistent with the intent and purpose of this resolution are approved; and, be it
Further Resolved, That the City Comptroller is authorized and directed to establish in accord with generally accepted accounting practices and City guidelines any and all subaccounts necessary to carry out the intent and purpose of this resolution and the Agreement; and, be it
Further Resolved, That all City officials, departments, boards, agencies, and commissions are authorized and directed to provide such assistance as may be necessary to implement the streetscaping project as described in the Agreement.
