Title

Analysis
Buses are currently prohibited from parking on the highways of the city except in areas designated by the transit stop technical committee.
 
This ordinance provides an exception for one or 2 spaces to be designated by the commissioner of public works at or adjacent to an intermodal passenger transport station.  Common carriers of passengers may apply for and receive a permit for up to one year for a monthly fee of $500.  The permit authorizes the common carrier to park or leave standing a passenger bus with a capacity to carry 24 or more passengers in the designated area. A permitted carrier is required to install a sign prior to parking in the designated area, and is required to remove the sign during any period of time that parking is not authorized by a valid permit.
 
Parking or leaving a bus standing in a designated area without a valid permit and sign is punished in the same manner as currently provided for parking at areas not designated by the transit stop technical committee. These include a forfeiture of not less than $10 nor more than $100 for each violation.
 
The ordinance further provides that the procedures for approval or denial of a permit application, and for renewal, non-renewal or revocation of a permit are the same as those provided at s. 101-23.7 for loading and unloading zone permits.
Body
Whereas, Intermodal passenger transportation stations, such as the upgraded and remodeled station developed with the support of Tax Incremental District No. 60, contribute to sustainable civic and commercial growth and increased opportunities for travel and tourism; and
 
Whereas, The City seeks to assure the safety and convenience of passengers arriving at and departing from intermodal stations; and
 
Whereas, The City further seeks to avoid unnecessary congestion upon highways adjacent to intermodal stations; now, therefore
 
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
 
Part 1.  Section 81-114.2 of the code is created to read:
 
81-114.2. Special Common Carrier Parking Permit. 1.  The fee for a special common carrier parking permit shall be $500 per calendar month or portion therof.
 
2. A special common carrier parking permit shall designate the month or months for which the permit fees have been paid. No permit shall be issued for a period exceeding 12 months.

Part 2. Section 101-23-2-c-4 of the code is amended to read:
 
101-23. Erection of Parking Signs.
 
7.  PARKING PROHIBITED IN SPECIFIC PLACES.
 
c. Bus Stops, Posting of Signs.
 
c-4. Special Conditions. >>c-4-a.<< The commissioner of public works may, whenever he >>or she<< deems it necessary under normal operating schedules, arrange for bus stop dimensions different than those referred to in subds. 1 and 2.
 
>>c-4-b. Notwithstanding the provisions of ss. 101-44 and 320-28 establishing and authorizing a transit stop technical committee to designate bus stops, the commissioner of public works shall designate the location and dimensions of a bus stop suitable for not more than 2 buses where, under conditions of a special common carrier parking permit, a common carrier of passengers may park and stand for purposes of loading and unloading passengers at an intermodal passenger transportation station. <<
 
Part 3. Section 101-44-1 of the code is amended to read:
 
101-44. Bus Stop Locations and Regulations. 1.LOCATIONS. [[No]] Except as provided in s. 101-46, no<< operator of a duly authorized common carrier of passengers may regularly stop on any highway within the limits of this city for the purpose of receiving or discharging passengers except at such locations approved by the transit stop [[subcommittee of the utilities and licenses committee of the common council.]] >>technical committee established at s. 320-28.<< Formal action by the common council shall not be required except in cases of dispute.  The infrastructure services division of the department of public works shall keep and maintain an appropriate record of such locations approved by the transit stop [[subcommittee of the common council.]] >>technical committee.<<
 
Part 4. Section 101-46 of the code is created to read:
 
Section 101-46. Special Common Carrier Parking Permit.  1. PERMIT REQUIRED. A valid special common carrier parking permit authorizes a common carrier to park or leave standing a permitted bus with a capacity of 24 or more passengers on the highway in the space or spaces designated by the commissioner of public works under the provisions of s. 101-23-7-c-4-b.
 
2. SIGNAGE REQUIRED. The signage required at s. 101-23-7-c shall, when placed at any designated intermodal parking area, identify the permitted common carrier and shall make reference to this section.
 
3. REFERRAL, APPROVAL AND DENIAL OF APPLICATION. Upon application to the city clerk and upon payment of the fee or fees required in s. 81-114.2, the city clerk shall refer the application to the commissioner of public works and to the common council member in whose district the designated parking area is located for investigation and recommendations.  Procedures for approval or denial shall be in accord with those procedures provided at s. 101-23.7-5-c to g for loading and unloading zone permits.
 
4. RENEWAL, NON-RENEWAL OF REVOCATION. The procedures for renewal, non-renewal or for revocation of a special common carrier parking permit shall be in accord with those provided at s. 101-23.7-7 to 10.
 
5. PENALTY. Parking at any designated intermodal bus stop without a valid special permit or without installation of an appropriate sign shall be deemed a violation of s. 101-44-1 and subject to the forfeiture provided at s. 101-44-3.
