Analysis
The resolution accepts sewer easement documents SE-2701A, SE-2701B and SE-2697.
Body
Whereas, Cherokee Point and Heritage Meadows Subdivisions require public sewer facilities to serve the proposed buildings; and
Whereas, In order to protect public sewer facilities, the City acquired permanent easements for sewer facilities SE-2697, SE-2701A and SE-2701B, with the right of entry in and across the properties and with right to construct, operate, maintain, inspect, repair, enlarge, reconstruct and relocate as may be or may become applicable said facilities; and
Whereas, Cherokee Point Bau Werk Inc. is the owner of Outlot 1 Block 4; and the Easterly ½ of Outlet 1 of Block 5 of Cherokee Point Subdivision, a recorded subdivision which contains sewer easement SE-2697; and
Whereas, The Lawrence Lubotski Trust is the owner of Parcels 1 and 2 of Lot 2 in Block 6 of Heritage Meadows Addition No. 1, a recorded subdivision, which contains sewer easement SE-2701A; and
Whereas, August Urbanek is the owner of a portion of Lot 2 in Block 6 of Heritage Meadows Addition No. 1, a recorded subdivision, which contains sewer easement SE-2701B; and,
Whereas, The existing obelisk is permitted to be located at the Southerly end of Outlot 1 of Block 4 of Cherokee Point Subdivision and that any future maintenance or relocation of said obelisk shall not in anyway cause harm to the City's sewer facilities located within the easement area; and
Whereas, If any future obelisk maintenance or relocation causes any damage to the City's sewer facilities, the Grantor shall perform any necessary repairs at its own cost; and
Whereas, The City will allow the location of existing obelisk in the easement area, subject to conditions stipulated in sewer easement document known as SE-2697; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the City of Milwaukee hereby accepts sewer easements SE-2697, SE-2701A and SE-2701B, said sewer easement documents being attached to Common Council File Number 011050 and incorporated in the resolution by reference as though set forth in full; and, be it
Further Resolved, That said sewer easement documents shall be forwarded to the Office of City Real Estate for recording and proper distribution.
