Title
Substitute resolution approving the Intergovernmental Agreement for School Security Program between the City and the Milwaukee Board of School Directors.
Analysis
This resolution approves the Intergovernmental Agreement for School Security Program between the City and the Milwaukee Board of School Directors (“Board”). Under this Agreement, the Milwaukee Police Department shall assign officers to work as School Resource Officers (“SROs”) in the School Security Program on a full-time basis during the second semester of the 2007 - 2008 school year and the first semester of the 2008 - 2009 school year. The number of SROs assigned to work under the School Security Program shall increase from 4 to 10, with 2 SROs placed at each of the 5 following schools:
Lynde and Harry Bradley Technology and Trade School
Custer High School/Lady Pitts
Hamilton High School
Pulaski High School
Vincent High School
The Board will reimburse the City for actual salaries, fringe benefits and overtime, plus indirect costs, of services performed at the schools, not to exceed $375,000 unless the parties agree otherwise in writing. The Agreement may be terminated upon 90 days notice in writing to the other party.
Body
Whereas, The Milwaukee Board of School Directors (“Board”) and the City of Milwaukee (“City”) both qualify as “municipalities” authorized to enter into contracts for the receipt or furnishing of services pursuant to section 66.0301 of the Wisconsin Statutes; and
Whereas, The City and the Board are dedicated to establishing and maintaining a positive partnership that promotes prevention, intervention, education and enforcement as a means of improving the safety and security in and around Milwaukee Public Schools (“MPS”) schools for staff, students, parents and the community; and
Whereas, On January 26, 2007, the Board approved Intergovernmental Cooperation Agreements whereby 4 School Resource Officers (“SROs”) were assigned to MPS schools, the Lynde and Harry Bradley Technology and Trade school and the schools which comprise “the Cluster schools,” during the second semester of the 2006 - 2007 school year; and
Whereas, Both of the Intergovernmental Agreements for SROs were extended under the same terms and conditions to cover the first semester of the 2007 - 2008 school year; and
Whereas, Both parties consider the program to be a success based on feedback from community-based organizations, the SRO Pilot Program Focus Committee, and principals, students and staff whose schools were served by the program; and
Whereas, Because of the success of the program, the parties want to enter into this Agreement, which covers the second semester of the 2007 - 2008 school year and the first semester of the 2008 - 2009 school year; and
Whereas, Under this Agreement the number of SROs assigned to work under the School Security Program shall increase from 4 to 10, with 2 SROs placed at each of the 5 following schools:
Lynde and Harry Bradley Technology and Trade School
Custer High School/Lady Pitts
Hamilton High School
Pulaski High School
Vincent High School
; and
Whereas, Each party shall assume the costs associated with 5 SROs; MPS shall pay the City a sum sufficient to pay the costs of the actual salaries, fringe benefits and overtime, plus indirect costs, of 5 of the SROs assigned to work on school security on a full-time basis under this Agreement, not to exceed $375,000 unless the parties agree otherwise in writing; and
Whereas, This Agreement shall terminate at the end of the last regularly scheduled school day of the first semester of the 2008 - 2009 school year; however, this Agreement may be terminated by either party for convenience upon 90 days notice in writing to the other party; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Intergovernmental Agreement for School Security Program Between the Milwaukee Board of School Directors and the City of Milwaukee is approved; and, be it
Further Resolved, That the Chief of Police is authorized to execute the Agreement with the Board, a copy of which is attached to this file; and, be it
Further Resolved, That the City Comptroller is authorized to:
1. Commit funds within the Project/Grant Parent of the 2008 Special Revenue-Grant and Aid Projects Fund, the following amount for the school security program:

2. Create the necessary Grant and Aid Project/Grant and Project/Grant levels, budget against these Project/Grant values the amount required under the grant agreement;
Establish the necessary City Share Project Values; and, be it
Further Resolved, That these funds are budgeted for the Milwaukee Police Department, which is authorized to:
1. Expend from the amount budgeted sums for the specified purposes, as indicated in the grant budget and incur costs consistent with the award date.
2. Transfer funds within the project budget as long as the amount expended for each specific purpose does not exceed the amount authorized by the budget by 10%.
