Title

Resolution authorizing the transfer of funds from the MPD Federal Forfeiture Revenue Contribution Account to the Police Department’s budget.

Analysis

This resolution approves the transfer of funds to the Milwaukee Police Department’s budget to fund items in accordance with guidelines of the Asset Forfeiture Equitable Sharing Program. 

Body

Whereas, The Asset Forfeiture Equitable Sharing Program operates through the U.S. Department of Justice; and

 

Whereas, The Milwaukee Police Department receives Equitably Shared Funds from proceeds of assets seized under the program; and

 

Whereas, The Milwaukee Police Department is bond to comply with program regulations as contained in the “Guide to Equitable Sharing for State, Local and Tribal Law Enforcement Agencies”, revised in March of 2024; and

 

Whereas, these guidelines state that “Agencies may use equitably shared funds only for law enforcement purposes that directly supplement the agency’s appropriated resources; and

 

Whereas, these guidelines further state that “…law enforcement agencies will not receive equitable sharing if the governing body or state, local, or tribal law, regulation, or policy requires or directs (1) specific expenditures of shared funds …; and

 

 

Whereas, the Milwaukee Police Department currently has funds held in trust (Fund 0678) to increase or enhance law enforcement efforts in the City of Milwaukee; now therefore be it

 

Resolved, By the Common Council of the City of Milwaukee, that the City Comptroller is authorized to transfer funds as requested by the Milwaukee Police Department from the Milwaukee Police Department’s Federal Forfeiture Trust Fund (Account Number 0678-3310-R999-2024-662201), to the contribution/revenue account entitled Federal Forfeiture Contribution Revenue (Account Number 0001-3310-2024-985012); and, be it

 

Further resolved, That upon transfer of these funds, the City Comptroller is authorized at the request of the Police Department, without further action, to transfer funds between account 0001-3310-0001-D375-0063000 and account 0001-3310-0001-D375-006800 in order to facilitate for proper accounting of all Federal Asset Forfeiture purchases as detailed above; and be it

 

Further Resolved, That all funds are to be expended to enhance law enforcement efforts in the City of Milwaukee.
