Title
Substitute resolution authorizing the City of Milwaukee to dedicate property for the improvement of West Fond du Lac Avenue and to accept compensation for such dedications, in the 7th and 10th Aldermanic Districts. (Department of City Development)
Analysis
This substitute resolution will permit the City of Milwaukee to dedicate portions of City-owned land for public right-of-way and to grant temporary construction easements for the West Fond du Lac Avenue improvements.
Body
Whereas, By passage of File No. 000012 on May 19, 2000, the Common Council of the City of Milwaukee ("Council") approved the right-of-way plat for improvement of West Fond du Lac Avenue; and
Whereas, The State of Wisconsin Department of Transportation has made offers to the City of Milwaukee for the land dedications and for temporary construction easements on small portions of City-owned vacant lots; and
Whereas, The City Real Estate Officer has reviewed the offering prices and determined the amounts to be reasonable; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the portions of the following lands as shown on the approved right-of-way plat are dedicated for public right-of-way purposes:

Further Resolved, That the proper City officials are authorized and directed to execute quit claim deeds or other documents to accomplish such dedication; and, be it
Further Resolved, That the Commissioner of the Department of City Development ("Commissioner") is authorized to sign construction permits for the State of Wisconsin to temporarily occupy the following City-owned lots to make slope and grading improvements for the consideration listed:

Further Resolved, That in the event that any remnant parcels are created as a result of other right-of-way acquisitions by the State of Wisconsin, the City of Milwaukee may accept title to such remnants upon the recommendation of the Commissioner; and, be it
Further Resolved, That if any additional parcels designated for acquisition or for temporary easements for the project become City-owned through an In Rem action or other acquisition, the areas designated for acquisition may be dedicated for public right-of-way and temporary easements granted without additional action by the Council; and, be it
Further Resolved, That upon dedication of the land, the proceeds shall be deposited to the City Tax Deficit Fund Account No. 334106, Fund 0001, Organization 9990, less a 15 percent development fee to be paid to the Redevelopment Authority of the City of Milwaukee.
