Title

Resolution approving a Maintenance Agreement between the Downer Avenue Business Association and the City of Milwaukee regarding the maintenance of accessory power outlets in the Downer Avenue business district.

Analysis

This resolution approves a Maintenance Agreement between the Downer Avenue Business Association and the City of Milwaukee.  At the request of the Association, the City has installed eleven harp lights along Downer Avenue between East Webster Place and East Park Place.  Accessory outlets have been incorporated.  A freestanding outlet was also installed on private property at the corner of North Hackett Avenue and North Downer Avenue.  This agreement obligates the Association to fund the electrical energy charges and any required maintenance associated with these outlets.

Body

Whereas, The Downer Avenue Business Association requested that the City of Milwaukee install eleven harp lights along North Downer Avenue between East Webster Place and East Park Place; and

Whereas, The Association further requested that accessory outlets be included with the harp lights and that an additional outlet be installed on private property at the intersection of North Hackett Avenue and North Downer Avenue; and

Whereas, The outlets will be used to power Christmas decorations and similar displays; and

Whereas, When accessory outlets are installed in conjunction with City street lights, it is typically the responsibility of the entity requesting the outlets to fund their power usage and maintenance; and

Whereas, The Association has agreed to take on that responsibility; and

Whereas, A Maintenance Agreement has been drafted and is attached to the file; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee that the Downer Avenue electrical outlet Maintenance Agreement attached to the file is approved and that the Commissioner of Public Works is hereby authorized to execute it on the City's behalf; and, be it

Further Resolved, That the Commissioner of Public Works is authorized to make minor, non-substantive changes in the agreement prior to its execution.
