Title
Substitute resolution relative to an appeal of the Historic Preservation Commission's action denying the application for a certificate of appropriateness for a vinyl wrap-around awning on the property at 1101 East Brady Street.
 
Analysis
This resolution reverses the September 21, 2000 decision of the Historic Preservation Commission denying a certificate of appropriateness for a vinyl wrap-around awning installed at 1101 East Brady Street (Brady Street Historic District), provided that, within one year of the date of adoption of this resolution, the owners have replaced the vinyl awning with one made of canvas.
 
Body
Whereas, The property at 1101 East Brady Street is within the area designated as the Brady Street Historic District, and the owners of all buildings within historic districts are required to seek a certificate of appropriateness from the Historic Preservation Commission before in any way altering the exterior of their buildings; and
 
Whereas, The owners of this property have requested a certificate of appropriateness for a vinyl wrap-around awning; and
 
Whereas, The Historic Preservation Commission, on September 21, 2000, rejected this request after a public hearing, citing, among other issues, inappropriate material and design; and
 
Whereas, The Historic Preservation Commission, on October 16, 2000, granted a certificate of approval for the installation of a canvas wrap-around canvas awning at 1101 East Brady Street subject to certain conditions; and
 
Whereas, The owners of this property have since indicated that they are not agreeable to these conditions, leaving in place only the September 21, 2000 denial by the commission of their request for a certificate of appropriateness; and
 
Whereas, The owners of this property, pursuant to section 308-81-9-f of the Milwaukee Code of Ordinances, are entitled to appeal the decision of the Historic Preservation Commission to the Common Council, and the owners have filed a request for a hearing of their appeal in a timely manner; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the September 21, 2000, decision of the Historic Preservation Commission denying a certificate of appropriateness for a vinyl wrap-around awning at 1101 East Brady Street is reversed, provided that, within one year of the adoption of this resolution, the owners have replaced the vinyl awning with one made of canvas.
