Substitute resolution to vacate North Commerce Street between North Dr. Martin Luther King Jr. Drive and West Cherry Street, in the 6th Aldermanic District.

This substitute resolution vacates the above portion of street in accordance with vacation proceedings under power granted to the City of Milwaukee by Section 66.297(1), Wisconsin Statutes, and Section 81-308-28, Milwaukee Code of Ordinances. This vacation is necessary for the development of the Harley Davidson Museum and the Commerce Street Power Plant.

BODY:

Whereas, It is proposed that North Commerce Street between North Dr. Martin Luther King Jr. Drive and West Cherry Street be vacated pursuant to the provisions of Section 66.297, Wisconsin Statutes; and

 

Whereas, This proposed vacation has been reviewed in accordance with Section 81-308-28, Milwaukee Code of Ordinances; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee that said portion of street, as indicated by Exhibit "A" and bounded and described by:

 

All of North Commerce Street in the Southeast 1/4 of Section 20, Township 07 North, Range 22 East, described as follows: Commencing at the point of intersection of the east line of North Dr. Martin Luther King Jr. Drive and the westerly line of North Commerce Street; thence Northeasterly along said westerly line to its point of intersection with the south line of West Cherry Street, said point also being the northeast corner of Lot 1 in Block 30 of Plat of the Town of Milwaukee on the West Side of the River, a recorded subdivision, in said 1/4 Section; thence Easterly along the easterly extension of said south line 12.39 feet to a point of curve; thence Southeasterly 99.01 feet along the arc of said curve which has a radius of 115.00 feet with its center lying to the south having a central angle of 49 deg. 19 min. 39 sec. and a chord of 95.98 feet to its point of intersection with the point of intersection of the present southwesterly line of West Cherry Street and the northerly line of Lot 1 in Block 31 of said subdivision, said point lying 24.36 feet Southeasterly of the northwesterly corner of Lot 1 in Block 31, as measured along said northerly line; thence Northwesterly along said northerly line 24.36 feet to said northwesterly corner; thence Southwesterly along the easterly line of North Commerce Street to its point of intersection with the east line of North Dr. Martin Luther King Jr. Drive; thence Northerly to the point of commencement, is vacated; and, be it

 

Further Resolved, That as provided by Section 80.32(4), Wisconsin Statutes, such vacation shall not terminate the easements and rights incidental thereto acquired by or belonging to any county, town, village or city, or to any utility or person in any underground structures, improvements or services, as enumerated or otherwise existing in said description of land above described, both easements and rights and all rights of entrance, maintenance, construction and repair of entrance, maintenance, construction and repair with reference thereto shall continue as if said portion of street had not been vacated.
